I-140 denied, not with GC sponser now.
Hi
I needed to leave six months after my 140 and 485 are filed by the employer. By that time 140 was not approved. By that time I got both EAD and AP. On 6th of this month I got e-mail from USCIS saying that 140 was denied. I came to know that there was RFE regarding my education qualification and company did not inform me. Company replied to USCIS saying that I was not with that company anymore.
I asked my GC company to reopen the case and they said no. I did not receive denial notice by mail yet. My 485 is not cancelled yet.
I have been jobless since Feb 2008 and my GC sponsoring company's H1-B visa is expiring on July 2. I am not sure whether we can extend H1 based on GC(140 is denied and 485 not denied yet)
In the last months I was out of country for 40 days and while entering I used AP.
I consulted two senior lawyers and the option given to me was get the AC21 invoked and have the case reopened by new employer.
Do you know what could happen when you revoke AC21 before 140 is approved? What are the chances?
How long one can stay in the country after receiving 140 or 485 denial notice.
Thanks
