First of all what is your aim of reporting to DOL?
If your aim is just to punish the employer and get money for 5 months probably you can succeed though time line you get result could be uncertain. Can you survive till that time may be for a few months.
Even if you succeed in getting money do you have a job to transfer H1b. By the moment employer knows that you complained he will fire you and cancel H1b. Now situation is tough in job market unless your skills are rare.

Report Them:- I will be involve in some legal issues, i have to mention it everytime i enter US. as most of the forms says "Have you ever been involved in some legal/criminal issues"
Do Not Report Them:- I have fera to justify this 5 months period as i do not have any employement/ tax filing history.
Has anybody experienced such problem, and what is better option??
