Can someone please help me witrh my particular situation. I have analyzed my situation from the posts that i have read. Need to know if i am correct. Thanks in advance!!
My OPT expires on 19th July 2007 . Adding the grace period of 60 days, I will be out of status on 19th Sept 2007.My employer has applied for H1 in masters quota for Oct 1st 2007.
As per my understanding, I can be in US 10 days before my H1 date which will be 1st Oct. So I can be in US from 22 Sept.. However I will still be out of status from 19th to 21st sept. ie for two days ! Not sure if this is entirely true.
I have an option of taking up a course at my Univ. But my advisor said I need to be a full time student and take another Masters course. Do i have to take masters course ( I did MBA previously) Can i take any course at any college? and then withdraw ? Because I will be working and I am through with studying.
Another Option would be for my employer to apply for extension. I dunno how this works and what are the risk factors. Can I apply for OPT extension. My start date for OPT was 28th August 2006 ending on 19th July 2007 which does not sum up to full one year..can I extend it?
I can also apply for H4 visa since I am married and my husband is on H1. However if my H4 is still processing and my H1 is approved in the mean time, How does that affect my status.. Can I cancel the processing for H4 If its still in process after 1st Oct?
Last option I believe is to leave US during the period I will be out of status , and get my visa stamping done from Canada .I have no idea about the risk if I go for this option. Do I have to go to my home country? And will my stay in US after the OPT expires for those 60 days grace period be considered a legal stay. Or will this be a problem if I go to canada for stamping?
I have asked a lot of questions and may be a bit confusing, I would still appreciate someone to help me with this.
