I have to say I am truely depressed by the news. With the flood gate open, I don't even dare to imagine when the Visa bulletin will retrogress to when it's open in October again... We are screwed totally.

I have only one question to backlog victims... My LC was in backlog - but I refiled it under PERM - got it. Why people don't do that? Saving money? I've heard people are "stuck" on I-140. I got mine in 3 weeks (including RFE). Why don't you do premium? Saving money? I'm not judging anybody and may not know the details, so people could have reasons... but still... - money is not a valid reason and "company doesn't want" - is not a valid reason either.

Bestia - not everyone has that option. I tried that too, but company wouldn't do that.
This is one of MANY issues that IV will still campaign for.
Please donate so we can carry on with rallies etc - it all costs money and we are low on funds!

Why is it that anytime someone stuck in BEC so much as expresses his/her frustration people jump and ask them to "enjoy the ride/shut-up" or just ask for the thread to be closed?
Do you have any idea how many years ppl have been stuck in BEC. I see a lot of ppl who have PD's in 2006-2007 complaining about retrogression and at the person asks BEC sufferers to shut up! There are thousands who have been stuck in BEC and their PD's range from 2001-2004.
Please have some compassion for ppl who are going thru a hard time.

Really sad for BEC Folks, I know how it feels like to be struck in backlog for years while many new people get ahead of you.. my sympathies with you. Hope the PD will be current for all the BEC folks in October

Can you believe it, I never even knew I had that option until about a month ago! My lawyer never told me, he just said to wait, wait wait. I never knew. This thing took years off my life. And the stupidest of all was me, because I was in that victim mentality thinking that there was nothing to be done, as they were BACKlogged and thus you cannot jump or do anything about something when they are behind on paperwork. :rolleyes:

Caught up in the frenzy, your ability to reason seems to have gone out of the window. While we understand your jubiliation, think for a moment what happens to people who can't file before 17th Aug. How long do they have to wait even if they get their LC on 18th Aug?
Let me quote my example. Here I am waiting with a PD of Dec 2002 with my LC application rotting in PBEC. I am on my 8th year of H1 and the meantime, my company was acquired by another one. New company refuses to convert the TR to RIR but files another PERM in Feb 2007. Since Atlanta PERM processing center has developed a backlog of its own, it took forever to process the pending applications. Finally it was certified last Friday and I may yet be able file for 485 before Aug 17. This was because I am fortunate enough to be working for a big company with considerate managers. But I would never lose sight of victims whose applications are still rotting in PBEC and who might have their hands tied due to their circumstances.
If you can't understand their problems, at least do not run salt in the wounds.

I know how you feel and you have my sympathies. I know someone else in this situation as well and she's pretty broken hearted by all this. How long have you been waiting?

I feel your pain. While I am happy for everyone (including myself) who will be able to file 485 now, I am sure IV will do its utmost to take this issue up now. We need more funds to carry on the process. I know that some core team members already had filed 485 but still they were waging the battle for us, the less fortunate ones. We will continue to fight for the ones stuck in BEC too.
To just give you a ray of hope, I think come October, the dates should still open around early 2004 so those people who are stuck in BEC should be able to file 485 very soon. Keeping fingers crossed for you and hoping for the best.

To every stuck in BEC, please ensure that you have ALL the paper work ready to file 140/485. I would say even get your medicals done and keep them ready. Only reason I say is say that your case is approved a week from now, if you start collecting documents then you will probably have a hard time making the deadline. However if you do everything from now on, you will be able to file before August 17th. Especially your certificate of birth and affidavits of birth are VERY IMP and you need them. GET THEM RIGHT NOW.
Also since you are in BEC, I am assuming you priority date is 2004 or earlier. So you have a very good chance of becoming current in October. Your labors should be approved by then since BEC is supposed to be done in September. SO you medicals if not used right now, should come useful then.
Again, there is a risk of wasting a few hundred dollars on medical if your dates done become current for over a year, but the upside is too good to not take the chance. Just my opinion.

We all have to be patient and put in our dues, i have waited for this stage for 7 years. In those 7 years my employers did not give me one raise, they knew i would not leave unless i wanted to leave america... So! For me it was 7 years, for some others maybe even more.. So please dont be sad or dissapointed whoever you are.. Just be patient and be happy that justice was done!!!!

Folks,
For those still in BEC, take heart. This news should not affect you in anyway.
The reasons are,
1. This is just a window to apply for 485. The GC itself is still light years away for people having PD > 2004.
2. All BEC cases will be processed in 2.5 months. That is about when the next year quota will open up and in all probability, most of you will be able to apply for 140/485 and what is more, since your pds will remain current, your 485s will be approved well on time.
In short, although many new PD folks can apply for 485 before you do, you will get your Gcs much much before them - which is what really matters.

And even if he weren't stuck there, I still don't think banning of someone who is sad because these news are setting their own case back is fair. We've all been waiting for so long, some of us are operating on bitterness and misery so give compassion not banning.

I was also a BEC victim until last Friday when online status chaged for my TR case to approved. I may barely scrape thru Aug 17th deadline to file I-140 & I-485. Unlike some people who are celebrating thinking that the battle is over, I would like to send a word of caution and restrain. I don't think the battle is over until you get GC in your hand. Miles to go before you sleep.This is just a temporary relief and you may be stuck with EAD/AP/FBI Name Check for many years and renewing all this junk and spending thousands of Dollars. The only relief is that you can choose your tormentor (read employer).
I am not trying to be cynical, but that's the hard truth.
Best wishes to those struck in BEC and also those who are going to be struck in EAD/AP quicksand.

I agree with you Almond. We have all been through tough times and been frustrated. My I-485 reached USCIS on July 2. I have reached the I-485 stage after 8 long years of waiting. I can totally understand bigtime007's frustration.
The next goal for IV would be to ramp up the fund drive and push for visa number recapture from past years. That would help alleviate the BEC fiasco.
Can we request admins to un"ban" bigtime007 ?
Now back to doing some real work. Almost the whole day has been spent on IV website.
While today's development is great news for folks in the 485/AOS cue, what happens with people in CP? With the opening of the floodgates, I am unsure when visas will be available to CP cases who were scheduled for interviews in Aug and beyond. I am a great supporter of today's victory, but I am unsure where CP cases stand now? Another 4 year wait?

Birth certificates are painful to obtain, do it asap. Fortunately for me I fall in Bombay consulate region so I HAD TO obtain it even to apply for H1 visa.

Agree, but this is still good news, not because of some immigration benefits we get, but it's a sign that USCIS could be attacked and the battle could be won. We are far from getting our GCs. It's my 8th year here, and I don't expect to get GC sooner than 3-4 years from now. I am June filer, so the July tornado will work against me. But I'm glad for July folks, because it's our little victory. It's a sign that "wanna be immigrants" do have power and we are able to achieve something.

My heart goes out to you...if its any consolation, you would still end up getting the GC before most of us since you have an earlier PD. Hopefully you will have your labor cleared by sept. Good luck

What about this : Rotting in Phily BEC for 5 years to clear labor and then
rotting in FBI namecheck for another 3 - 4 years to clear I-485 ?

Are you sure, I asked this question on another forum and I was told that after you submit your I485 they're looking at your Receipt date and not your priority date anymore. I'm so confused now.

Here is what I think is going on. Formally they go by receipt date. If the whole system wasn't screwed up that much, then going by receipt date would be the same as going by PD.
But after asking people around, checking tracking web-sites, reading on forums I think they favor older PDs. As older PD as the waiting is less on average.
Although they sometimes approve recent cases, maybe it is up to officer or division.

Agh, this lack of proper structure is so annoying. Fill this paperwork, send this one in, respond to this, check that, and in the end we have no idea of what's happening. I'm going to call customer service tomorrow to ask-a few times, to make sure they all say the same thing:D

I can guarantee that the BEC problem is still on the agenda for IV's campaigning. It's another battle in the list we have
Thanks to all those that donated after my nagging everywhere - this will obviously help us to continue these fights.
Lastly, a little story about what BEC is.
Once upon a time, the Labor Certification stage was different. In these days (before late March 2005) Labor Certifications had a different process. When the PERM process started, all the old applications under the old system were sent to "BEC" or the ironically named "Backlog Elimination Centers".
In reality, these centers did not Eliminate any Backlog, so there are still TO THIS DAY, many pre March 05 PD people stuck in a black hole of delay awaiting for their
These delays have supposed to have been cleared many times now. Statements are made that "we will clear the backlog by X date" to be retracted and revised on numerous occasions.
So, really, it is highly understandable that those STILL stuck in these Centers are rather disheartened by today's announcement.
Please, people, have some humanity. Just because today is good for some, spare a thought in your celebrations to consider the pain this brings to others. Chances are, these people have been waiting in line longer than you have.
We are in this for the long haul, the BEC victims still have support from IV and we'll be fighting for you.

Hello Guys.
Hang in there. My TR PD is early 2004. I just missed June Visa bulletin because PBEC sent the LC after 2 weeks. That is how I ended up in this mess. Now I can apply and I feel sad for all you guys stuck there because I know that pain (my reputation is red because of it but I don't care).
To all the other guys who don't understand why we did not convert to RIR know this:
This was not suppose to happen. For years (after PERM) all I-485 filings were done by the priority date. That being said, re-filing under PERM would only give the confort of having the LC approved (less stress maybe) and having an I-140 which was providing 3 year H1B extension. Some of us were told by the lawyers that the risk is not worth it, some of us were stoped by the employer and some of us just did not like the risk (that is my case). Is not that easy to abandon a 2 year old application for a brand new one, especially since the BEC's were created to expedite this thing.
One thing I want to say to all BEC victims: Some of you may be able to squeeze the applications before Aug 17. The rest will most likely be able to file after October. Is not fair what is happening to you guys and I will not say that life is unfair and you should suck it up.... Your time will come also and I am sure it will be soon and before others that apply now and that is the way it should be.
