Labor Substitution - 485 Without 140 Receipt?

Hello,

Mine is a Subsitution case. My 140 was filed last week and I do not have the Receipt for it. Can I file I-485/EAD/AP without the Receipt for 140, or, is it that if I file USCIS will reject it!!!

I am in the same boat.. My I-140 was filed on 10 july..I dont have the receipt yet.. But I found out this update from the NSC about this..

According to this you can still file I-485 without the I-140 receipt.. I need to double check with my lawyer though..There must be lots of folks in this situation..Hope this update is still valid..

I filled my 140 on June 28th which reached USCIS on june 29th . It was the last day anyone could file PP for 140. I filed my 485 without any recepit/APPROVAL on 2nd july which reached USCIS on 3rd july. My 140 was approved on 3rd and i received approved petition on 4th .. never received any recepit.

Now my 485 does not have 140 recepit or approval notice or cover sheet which says that 140 was filled. it does have labor approval copy. Please suggest what can be a problem in this case ... do i need to send them a new 485 with approved 140 or is the old one fine.

as much as I hate labor subs, I'd suggest you to contact your lawyer on this one ...

Option 1: Get the recipt number from encashed check (see your back account online ...), then use the number to file

Options2: Wait until u get the recipt...its worth waiting

Options 3: Write a note with your name, ssn, I-140 tracking number, etc.,...and say the reson for not giving recipt nhumber...FIRST PAGE IN UR FILE....

I recomend option 2
