View Full Version : RFE for cases without Medical Reports

Guys

I am stuck abroad and I am trying my best to be there by Aug 17th. In worst case if I come there on say Aug 15th, then I wont be having enough time to get the Medical done and reports ready.

So, if I apply without Medical Reports,

1) do I need to wait till I get a RFE from USCIS with respect to that and then only submit the medical reports? Can I submit the medicals 1 week after submitting the 485 package?

2) Does USCIS provide the RFE only when the dates are current for my case. Can I expect the RFE ( based on medicals missing ) even during the time when my PD is not current.

3) Will I be getting EAD/AP first before the RFE? or only when the RFE is respnded then one can get the EAD/AP.

USCIS has announced that it would NOT REJECT applications without medical. This applies to applications received until August 17. USCIS starts working on cases even if PD is not current, so most likely you will receive RFE for medical soon after applying. But don't worry. As long as your app reaches USCIS by the end of business on August 17, you are OK.
Using your attorney, you can send medial reports later, but it is better to send them when RFE arrives. This way you send medical records along with RFE request, which is better because it is officially asked by uscis and it will surely be updated in your case. It is hard to say if you get AP / EAD before RFE...nobody knows the answer to this question.

To apply you must include your I94 and include the number.........

My recommendation is go to the airline counter, they usually have blank I-94, include that number in your application, and after you enter to the US go to a scanner, (usually the airlaines bussines center have ones and send it over your attorney)

If you are abroad, you need to include the I-94 too... but look this is my recommendation, go to the airline counter, they usually have blanks I94, use that number for the I485 forms. then as soon as you arrive to the US after immigration go to any bussines center in the airport, if you dont have membership you can pay a temporary one to use their scanner and usbmitte your I94 on line

Can someone please confirm this? Some of the single applicants in my office are planning to submit 485 without medical so that when their PD becomes current, they won't get a quick approval but an RFE. This will give them time to file for their spouse.

You mean not sending medical would not really help singles delay their approvals since RFEs may be sent even though the PD for the applicant is not current?

Medical is required for consular processing, and almost all countries have U.S. Embassy-approved physicians who can do the medical report for you. This way, you will be all set to go when you are in the U.S. Just a thought. Please check and confirm.
