After persistent requests to talk to IO and re-requests, I came to know that my name is stuck with FBI's name check process. In fact, it is the second name check that is delaying my 485 approval (the first one came thru, it seems in early 06). My second FP in June 2007 came thru in a few days but they could not process my application because of the name check issue! My pd is Dec 2004 and RD is Aug 2005, EB2 NIW. Has someone found a way to deal with a situation like that? Please shout. Thanks.

I am from India and do NOT have a muslim name. Ironically, my lawyer mentioned that my name appears to be something that would come out of FBI machines as "No Records" immediately ( unless there is a file on me or something, which i don't believe). I called up FBI and they said they are overwhelmed, NNCP (name check program) has stopped contacts with public, and only ways to reach out to nncp is via the 'agency that requested the service'- USCIS in my case- or congressional office. Has anyone successfully prodded uscis to followup on a namecheck with FBI?

Were you ever flagged for name check during H-1 or H-4 Stamping at a consulate in India. My wife was flagged in Delhi consulate during H-4 stamping and she has a common hindu name.

We have never been flagged, have a not very common indian name..still stuck. I think they need to revist and fine tune their software programs.

I am ok (actually i hope and pray), some lawmaker proposes a law to charge $100 specifically for name checks and provide a 3 week processing window or a letter stating why the individual was flagged if the name check is not cleared within the time frame.

The sad part is that we have no recourse, there is no one who can give a estimate.

The only known way out of FBI namecheck is a Writ of Mandamus Lawsuit, but it is costly:cool:

I have a benign first name (Hindu) and a benign sounding last name (a commixture of two names). If they flag any of these two or combination of their parts, many Hindu, south indian applicants would not have gotten their GC in the past 40 years ;-)

Writ of Mandamus costs around $3K. Add another $400 for commuting to the courts for both of us. As far as I know, my name had not been flagged during H1 stampings. I dont recall any mention or problems with my name during interview etc.
