I will be getting my US citizenship in the next couple of months (I hope) and I want to file for adjustment of status for my parents. They are divorced, but living in my house, because they obviously can't work and can't support themselves. I was wondering if I could claim them in my taxes, because they have no income, so they can't file taxes. My mom has a bout 2k in wages from last year, before she was laid off.

Please let me know if you know that this situation could cause problems when applying for them. They are divorced, but unable to go anywhere else. I remember that when I applied for adjustment, I was requested to show my taxes.. That is the reason I want to include them in my tax return. I also know that they ask where you lived in the past years, and I'm afraid that if I put down the same address, they might deny the application.

I really need your help, because I just can't sleep thinking about this problem. If it helps, I am married w/2 kids.

See the following: (as per my knowledge): Rules to claim Parents as dependents in tax returns
a) If your parents are US Citizens or PR holder (they have Social Sec or ITIN numbers)
b) If your supported them in 2009 (like paying insurance, paying their rent/mortgage/daily expenses/incidental expenses/medical expenses/utilities/travel expenses etc-- all or some of these items.)
c) and their 2009 annual income was less then $3800
d) and they are not filing their individual tax returns(not 100% sure on this)

Then....
you can claim them in your tax returns as dependents.
You may want a list prepared, in case you get scrutinized by IRS etc.
The list should have all the expenses that you paid for them, also, calculate amounts that you paid for them and write them down(for example, they stayed with you, then you divide the utility bill accordingly and write that amount in the list etc.).

There is a form in IRS that you have to fill out, basically, it asks for all the things that I listed above, unfortunately, I dont recall the form number.

You may want to ask some CPA/Tax preparer for the form number or look it up on IRS website.

Thank you for your response. I'm not trying to get a refund back, or anything. I'm just concerned that they're required to file taxes (I remember that they asked for my taxes when I applied) They have no income, so I thought it'd be best to claim them on my return.

Also, the living together part even though they are divorced scares me.

Please if you know that this is going to be an issue, let me know..

HOW THEY DID WORK ? WHICH KIND OF VISA STAUS THEY ARE HERE ?
THEY ARE ILLEGAL HERE AS PER YOUR DESCRIPTION.

I am sorry. I'm very confused with all these posts and threads. They are not here illegally. They just can't work because of age.
I think my question was misunderstood. Thanks for all your replies.
