View Full Version : Connection between I140 and EAD

Hey Guys,
Looks like a lot of people who have 140 approvced are getting their EADs quickly. It's true even with a guy who sits next to me at work. My 140, 485, EAD are all applied on the same day June 29th. Does my 140 need to be approved before I can get EAD? What happens to my wife's EAD who is filed as a dependent?
Please share your thoughts. I am quite anxious as it's very important that my wife gets EAD soon... Thanks a lot...

The EAD is for a pending 485. It has nothing to do with the 140.

My I-140 approved in Apr 2006. I received my receipt notice. Still waiting for FP Notice and EAD.

I am not 100% sure but I think EAD/AP has nothing to do with I140 approval. My I140 is pending due to background check since October 2006 but USCIS NSC cashed my checks for EAD/AP yesterday and I guess they will now process and approve my application. I filed for my EAD and AP on August 15.

I just came to know of someone in my company who also did concurrent filing like me. They already got EADs and FP notices, but didn't even get I-140 receipt numbers. So there doesn't seem to be any connection between these two things.
By the way, everyone I know who got EADs from June/July batches got it from Texas service center. Does anyone know of Nebraska EAD approvals?

I haven't seen any. However, some cases were also moved to California and they seem to be getting EADs very quickly too.
Its not advisable to use EAD before I-140 approval... But guess people do get and do use EAD beforehand...
Keep in mind:
1) You CAN work with EAD, but use of EAD will invalidate your H1 status.
2) You are NOT eligible for AC21 until I-140 is approved and 180 days after I-485 filing (RD or ND??).
So its recommended to maintain H1 status till your I-140 gets approved and your I-485 hits 180 days...
Again, its my 2 cents... And I am not a lawyer... Just a fellow like you...

How do you know your 140 is pending "due to background check"????
