Why Vermont Center is not processing H1B extensions? Has anyone noticed this. For the last two months there has been absolutely no progress in the dates for H1-B extensions filed at Vermont.
Anybody in the same boat as me?

It will be 3 months next Friday since my H1B extension is filed and pending. I have decided I am not going to pay USCIS a dime for premium processing. I have asked my sources in India to send me an Internation Drivers Permit to resolve the situation that may arise if they don't approve my case before Friday.

I filed for H1 extension in April and received it on July 28th . During that time also there was no movement of dates but people were receiving approvals all the time. Its just taking more than normal time.

My company sent my H1 renewal for premium processing and received an email notice from VSC stating that my case would be adjudicated in the next 15 days. I guess all the USCIS cares about is money and it is a deliberate go slow on their part for normal cases. I had a friend waiting for 10 months for his H1 renewal before he moved on to premium processing, then he got it in 15 days.

But in NJ, you can get a temporary extension. I got an extension of 2.5 months a couple of weeks back (not sure what the reasoning was for this duration). The general advice here in NJ is try more than one DMV as not all are aware of USCIS rules and delays.
I guess Vermont Center is expecting everyone to pay $1000 and get permium processing done for their H1B extension. I am not going to pay even a dime. Instead I might spend that money on charity :p

My H1B extension has been pending at VSC since June 4, 2007. I am personally aware of several individuals with extensions submitted after mine that got approved recently. At the same time, I am also aware of people who filed before me who are also waiting.

Is there any maximum timeframe within which USCIS is supposed to process I129 extensions (H1B extension)?

Below are my H1B application detail it was filled in late july and i got approval on october 11, my current H1b is expiring on may 1 2008, so the logic that whose H1 expire early is approved early is not right as in my case.
Receipt Number: EAC07209534XX
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Approval notice sent.
On October 10, 2007, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
You can choose to receive automatic case status updates, which will be sent via email. Please click here to create an account online.
Who told you that USCIS process H1s based on expiry? Thats 100% wrong statement. Everything at USCIS is processed by application Receipt date.

dpp, this is what i am saying that there is no concept of whats expiring and waht not, but if you read down in this thread you will see people saying that wrong thing
Ok, anyway USCIS don't bother whether a recently filed H1 expires or not. It is applicant's responsibility to file in advance and to be in status.

If my Premium processing receipt date was 2nd November (Originally June 2007 and then i converted to premium), when can I expect the response/approval?
I know its 15 calendar days, so it should be 17th November or its really 15 working days?
I have not received any response yet.
Thank you.

I came across a question by someone which states that The application is moved to Normal from Premium if you received a query. is this true ? My attorney has already responded to the RFE but we have not heard back anything.

Languished regular H1B Extension filers at VSC may want to write to USCIS Ombudsman about the interminable delay in getting their applications processed. Clearly, VSC is giving priority to new H1B and PP filers. This inordinate delay is affecting travel plans of regular H1B Extension filers.

Can you ask your friend if he received it in exact 15 days? I mean what was the start date and receive date? I am kinda stuck in a situation where i converted to PP and got RFE, then reponse was sent on 2nd Nov (As per USCIS website) and I have not heard back from them. So I am kind of worried as I am getting married in December (Going to India) and have to apply for H4 and do my stamping as well.

Hi Guys,
My H-1 is expiring some time in Dec 2007. I applied for 3 yr extension in Aug and still havent got my extension. My employer told me even if it gets approved after H-1b expiry I m still good. What he says is that once you have applied for transfer/extension etc you are safe even if the actual one may expire.
Can anyone let me know if it is otherwise? In that case I have to apply for premium. I don't want to give them easy money......

Your employer is correct, as long as you file extension prior to expiration of the current H1, you are good, even is the approval date is after the expiration

My H1B-extension approval time is 1 month(with RFE)...got approved on November 16th/07.
If you've filed your H1-B extension before the expiration date then you can continue to work. Unless you are expected to travel outside the country, going for a premium processing doesn't help much.

Friends
My H1 Transfer was filed on 6th June 207 in Vermont SC and No update till October 2007 so I converted to Premium in October and they sent a RFE. We responded to the RFE and on 2nd Nov they updated the case saying "We have received the response .." And LUD changed on 11th Nov 2007.
Since then, there is no update. Can anyone suggest what may be wrong? What are my options?
How about changing employer to a well known company?

Your case has been in pending status for about 210+ days - you should stop working on 240st day, which is < 30 days from now. If you continue your employer without alternate status like EAD, you will be considered as unauthorized employment; this could lead you into lot of serious trouble - you will be bared from entering US.
You should have received the decision with in 15 days from Nov 2, 2007, since you upgraded your case to premium. Ask your attorney/company to write you CIS ombudsman and expedite the decision, also open a service request with CIS, they have special email id for premium cases. Your attorney should be able to help you out.
Your case is still pending, may be due to - (1) you were out of status (2) DUI ticket (3) Struck in security check. Take a infopass appointment yourself and see whats the status, the local IO should be able to guide you thru. Act fast, you have less than 30 days before it is too late.
