Received RFE email - 11/20/07

Need to travel to India - 12/22/07
I haven't received the actual RFE letter so I dont know the reason.

Do have few questions so please help if you can.

1. What are the possible RFEs on I131?

2. Is there a way to find the RFE reason before receiving letter in mail? (like by calling customer service???)

3. How can I further expedite I-131 so that I can still travel to India on 12/22/07.

Per current trend - clear copies of passport, all I-94s and DL

Most likely, you may not get the reason(s) - Some CSRs may provide information.

If you have any medical emergency you can by taking an infopass appointment - attending marriages are not considered as emergency

My wife needed to travel to india at the earliest, i applied my AP on oct 1 and got the approval in hand on november 20th
steps followed
1. Applied in normal process (without I 485 recipts since they were not issued)
2. Around november 7 my wife got some job related emergency and wanted to go to india
3. Went for finger printing
4. Took infopass appointment and went to philadelphia with I-131 receipt, 485 receipt and letter from doctor (indian) that direct relative (parents, brother/sister) of my wife is sick and need some assistance
5. Infopass rejected it saying that its not in there hand need to talk to texas office
6. Called tesxas office automated system gave me a fax no to fax all the above document
7. Waited 2 days after faxing
8. Called again and spoke to level 2 CS and asked him to enter my emergency in the system and request to expedite (note told him that my wife is only child so she need to be there)
9. CS said in 4-5 business day someone will contact and on 5th day received the approved AP by DHL next day delivery

I have put in the same at Nebraska center 4 days ago but have not hear anything

No there was no status update or anything, but it happened exactly 5 business days after my request was put in the system by some whom i spoke on the phone.

We received AP by DHL next day delivery and when we got it the same night status got updated to document mailed to address we have on file

Same here. On 5th day of opening expedite request, saw LUD on AP. Next day saw an e-mail saying -document mailed to address on file. Wait 30 days to receive.'
I called them and level 1 CS rep told that they have sent my USPS and wait.
However they had sent it by DHL and I received it on the next day itself..

Hi ,

I call 4 times on INS call center for urgent I-131 . They told me to fax emergency document to INS department . I faxed all document same day .No response. After that I took appointment in Infopass . I talk to INS officer explain my problem than he again told me to fax document to INS and he put notes on my case. Same day I got Query on I-131 for photo .
We send photo 2 week back . Still waiting for response from INS .

Anybody know how much time it would take process I-131 after query .

I've had the same experience as well. It was a combination of Congressman's office and infopass..with a dr's fax about father. After approving my spouse's and daughter's AP filed 5 months ago, we got the packet the evening of the infopass..So maybe it was the expedite request from the Congressman's office.

they've also approved my AP filed 2 weeks ago. Waiting for another DHL packet today :)

TSC seems to have a problem getting the e-filed I131 with its supporting docs. A friendly IO told us to courier the pics again as he did not see the pics in the file. That helped..otherwise instead of the approvals we would have seen RFEs. I've decidedf not to e-file!

Would you please elaborate on this. What does it mean by computer generated? How did you take your pictures before and what have you done different now?

The pics need to have resolution higher than 3.4mpixel. The pics we sent the first time probably did not meet the mark.

So after the RFE, we sent pics taken from Fedex Kinko and these are also digital but the resolution is much higher and as per passport pic specs.

In case you take pics at home, do not zoom in or add light etc...It's always better to get pictures from authorized shops instead.

:-(( I am in a fix. I came to Chicago on a B1 in July, 2007 which was stamped till 4th October. Applied for an extension in September and the case is still pending. I had requested for an extension till January 4th, 2008 . Now meanwhile I happen to be married to a US Citizen and we have filed I-485, I - 130, I-131 & I- 765 and got the receipt. My queries are :

1 ) Does the receipt delivery imply that the form is complete and valid ?

2 ) I need to travel to India for my traditional wedding ceremony and since there seems to be some astrological predictions as in there are no auspicious dates after March 10th for the next two years ( might only hold good for my caste :D ), my wedding fixed on 9th March. I have the receipt of I-131 as on 12th December. Now I dont see much hope of the process getting done by February to travel for the shopping and all the preparation. What can I do at best to make sure that I manage to make it to my wedding and donot make a mockery of myself ?? !! Also, I am presuming that my I-485 pending status allows me to stay after my B1 expires this January 4th ( though it is still pending :D )

Also, I forgot to mention !!! I mentioned the reason for travel as honeymoon on the cover letter since I did not wanna confuse those guys with the different versions of marriage. Does it sound good ??

However serious your issue may be...Your reason for an urgent AP will seem insane to CIS. In my opinion, urgent AP request is for those, who had some unexpected emergency at home/work and need to travel outside. This provision is expected to be used on a need basis. Good luck with your quest.

Thanks Anil for the reply :) I guess I should have done some 'googling' before I submitted my I-131 :-( How can I correct it now? Can I submit another I-131 stating some 'medical' reason of family. I know it doesnt sound like a nice thing to do but then the invites to the wedding have been already distributed and its gonna be really dramatic if I am not gonna be able to make it !!!! If yes, what would be the perfect time to submit it since it sounds stupid to me to be asking for travel in February if someone is bed-ridden now. I ideally wanna leave by mid-Feb so :-)

I think you should keep your original reason intact. You should probably word it as it being a religious and traditional thing which has to be done between the dates you need to travel and so you have a religious need for which you need to travel.
I would recommend involving an attorney for professional advice and peace of mind.

Bingo :) May be I shall just send in another Cover Letter as an addendum to the Form I-131 I have already filed, if that makes sense !! :)

Can you post contents of Emergency letter. We got ur AP approved with Wrong pictures. We resubmithed them again they said it will take another 180 day. My is planning to go to india after 4 years.

What is procees "Congressman's office" to expedite I-131 .My wife need to go india ASAP.
We called many times INS and try to expedite process , Nothing is happening .

We got query from CRIS about photo . After sending photo and calling 3 times they send us email that your case have decision to expedite.

We faxed the medical certificate for my wife's mother on 8th Jan.

Now NSC customer service is saying that we need to wait for further decision. Spoke with our local Infopass office today and as per them we should get something in 3-4 weeks. They gave us an option of getting new AP at local infopass office by filing new fees all over again.

Has anyone on this group faced similar issues? How do we go about getting approval once we file for expedited request? I though once we open a new SR, we should get something back within 5 business days? Any help would be appreciated.
