View Full Version : Strange I-140 RFE

Hi,
We received the following two RFEs on my EB2 I-140.

1) In plain English detailed description indicating why five (5) years of post baccalaureate and progressive experience would be necessary to successfully perform the duties set forth in a highly technical job description.

2) Describe the position being offered so that it can reasonably be determined whether the job actually requires an advanced degree or five years of post baccalaureate experience that is progressively in nature.

My attorney tells me that this is a strange RFE and she has not seen such a RFE in the past. Has any one received this kind of RFE ? If so, could you provide me an insight as to how we could frame a proper response so that we can get the I-140 approved without further queries or denial. Please advise.

Isn't that responsibility of DOL to see if the requirements for the job are properly defined or not . I bet this is from NSC for EB2.

make a solid reply... Write at least two pages of the job duties... you know what will make this an easy winner for you, just tell USCIS that for the same positions in the company they have hired folks with MS or BS plus 5 years.... If your company can give a letter like that, USCIS will have no option but to APPROVE this...GOOD LUCK..
