Hi All,

Here is my question.I changed my employer A.Lets say today is day 1 of the moth.I stopped working for employer A , on day 15 of the month.Then I received my last paycheck from employer A on day 21.

I Joined employer B on Day 15, and they started my H1b Transfer, there was some delay, and attorney is now in good communication.She had all the paperwork from me on day 22.I work in CA , live in MO.So she said she needs to get prevailing wage determinations from CA , MO.Then she can file H1b transfer.
She sent request for prevailing wage determinations.Possibly in how many days she may receive them.She said once she receives them she will file for H1b transfer.

Is it the same procedure lawyers usually follow for H1b transfer.Any views are appreciated.

Thanks for your response.I am more worried about Prevailing wage determinations, how long they may take , any ideas.

By law, you should not join your new employer until you have a proof that they applied for a H1B transfer (i.e. Receipt Notice). Since you have joined, it is question of applying your H1B transfer ASAP. Your new company has to do a H1B LCA, this will be submitted along with I-129 (i.e. H1 transfer). In the LCA, company will fill up wages and position and etc... To get the LCA approval, it takes about 3-6 hours with the fax back facility. Hope this helps.

Hi Wand,

I have accepted offer on 16 , but I am joining on 3 of next month.I asked this new company my startdate would be 3 rd ad I wanted to file H1b, then I came in communication with lawyer,she has all the papaerwork from me,she said she would h1b only after getting prevailing wage determination, she is waiting on them.Is she doing the right thing.How long would prevailing wages takes to come back to her.

Any response is appreciated.

It take about 3-6 hours tops to get your H1B LCA approved - You give it a day or two tops and make follow-up with your employer. Without this LCA , your attorney can not file H1B transfer, as it is one of the primary documents.
