I recently got my Eb2 India Employment based I-485 approved. I am going to file my spouse's I-485 soon and was wondering what address I should send the forms to.

The direct filing address says
USCIS Chicago Lockbox

For U.S. Postal Service (USPS) deliveries:

USCIS
PO Box 805887
Chicago, IL 60680-4120

For Express mail and courier deliveries:

USCIS
Attn: FBAS
131 South Dearborn, 3rd Floor
Chicago, IL 60603-5517


However my attorney says we need to send it to the Nebraska Service Centre as my application was filed and approved there.

So should my lawyer send it to the Chicago lock box or NSC? Please let me know if you have personally done this recently after the addresses changes

ags123, not to alarm you, but is it possible to apply now for your wife? Since you already got your 485 approved and crossed the proverbial line into the gc land.

Yes it can be done for 180 days after approval given that marriage occured before approval.

My confusion is with the lockboxes.

The application says file at chicago lockbox

The lawyer says Nebraska Service Centre.

Anyone who has recently done this please let me know.

USCIS Phoenix or Dallas Lockbox, based on where you live.

I think this box is applicable to you

Based on a pending or approved Form I-140, Immigrant Petition for Alien Worker. (Note: You cannot concurrently file form I-485 and form I-140 at a USCIS Lockbox facility at this time. Refer to the Filing Instructions on Form I-140 if you want to file the forms concurrently.)

(You must include a copy of the Form I-797C Notice of Action, showing that your Form I-140 was accepted or approved.)


Please note the addresses were revised fairly recently (12/03/2009). Your lawyer may not be aware of that.

spoke to the lawyer and they said they have experience last month of filing a I485 similar to mine at Nebraska and had no issues.

So I guess I will have to trust them and see. She also mentioned 2 yrs is the time for follow to join not 180 days.

Good luck! Even if your lawyer is wrong, Nebraska will send the application to its correct destination.

Hey ags, I'm Confused here. Are you sure we can add spouse after the approval of I 485, providing the marriage certificate has a date of prior the approval date?
So if I do AOS on I 485, can spouse do counsular processing?
Is the time line 2 years or 180 days?

Per Lawyers response both AOS and CP are possible. When I mentioned 180 days the lawyer mentioned it is 2 yrs not 180 days for follow to join.
As long as marriage is before 485 it can be applied.

My question is where to file and I am going to go with Nebraska for now as I cant conclusively get any official source which says chicago lock box.

Sorry for asking many question, when you are trying to find answers to your problem.
I'm trying to figure out my situation, you have replied "As long as marriage is before 485 it can be applied." : before 485 means the day of filling the I 485 or the day of I 485 Approval ?

Which means I can do just the registration of the marriage in my desi (legal) before the I485 approval, then come back to USA, apply for Counsular processing (I485) for my spouse with in 180 days, once spouse's application is approved spouse can come to USA?
*** IS this possible?

As long as your marriage date is prior to your 485 approval date and the dates are current(means your priority date) you can apply for spouse 485.

I am also in the same boat and I am waiting my priority date to be current.

I got my 485 approved

If my priority date is current, spouse's priority is should be current as well? right? Does she will have different priority date?
Another question, how is your I 485 is approved when your priority date is not current?

I am in the same boat and need to post the paper in the next couple of days. Can somenoe please help me. I would greatly appreciate your help.

My priority date is Oct 2005 and i applied for i485 (EB2) in July 2007. I am planning on filing i-485 for my wife as a dependant/derivative of my application on August 2, 2010. My i-140 is approved. My case is pending at Texas Service Center. According to the i485 instructions and USCIS website (both revised on 12/03/09), the application has to go to :

USCIS
Attn: AOS
2501 S. State Hwy, 121 Business
Suite 400
Lewisville, TX 75067

My lawyers office informed me that the address to post is:

4141 N. St. Augustine Road
Dallas, TX 75227

I couldnt find this Dallas, TX address on neither the i485 instructions form or the USCIS website. Can someone who filed recently (after 12/03/09) to Texas Service Center confirm the correct address please. It would be of great help since i need to file the papers in the next couple of days.

Yes, spouse can be added within 180 days of the the primary applicant's 485 was approval, if marriage happened before primary applicants 485 approval.
