Missed the cut off dates by a month...need to revisit some of the calcuations that's the guru's put together. As usual, USCIS has a strange way of moving the dates (USCIS predicted some where around Mar & Apr 2010) and suprises everyone.
What a day to start with.

What you heard is incorrect... All dates until May 07, 2006 (included) are eligible.
Care to read the actual bulletin for clarity ?!!

Only applicants who have a priority date earlier than the cut-off date may be allotted a number

Pardon my ignorance but why do you say a wait for 1 yr. Wont the dates move forward in the coming months?

very bad, thought of moving to end of 2006 for EB2, feel sad for eb3 folks...

Look at last years bulletins, the bulletins this year will follow the same rules.
The SOFAD which is known as (Spillover Fall Across and Down) will happen in the last quarter of the next fiscal year so the wait is one year.
As far as now the date is May 8 2006, this will retro to March or April 2006.
USCIS is following the same ways that they did last year.

G2) Dozens of volunteers - who are willing to take that extra step and contribute time and effort for the sake of others
G3) Hundreds of donors, both regular or one-time - who trust IV leadership and commit to the cause without any qualms whatsoever
G4) Thousands of members - who try to understand the issues we are facing but do not have a realistic assessment of how bad things are
G5) Many more - who either are not bothered by this wait or who simply gave up on this process and became dormant of some sorts of their career
While the predictions thread provided some clarity and entertainment for EB2 folks, this September 2010 bulletin is a blessing in disguise for all of us.
Current state of our Members (M):
M1) We have recently greened EB2 folks (2005-2006 EB2 folks), who have a fresh memory of the painful wait
M2) We have folks who relied on predictions (May 2006 - Jul 2007 EB2 folks), who must be frustrated and disappointed with today's bulletin
M3) We have folks who were looking forward to Jul-Sep 2011 (Aug 2007 - Dec 2008 EB2 folks), who now realize that their wait is even longer than assumed
M4) We have EB-3 folks waiting forever and feeling that they are being neglected in IV advocacy efforts
Folks who are in M2/M3/M4 state above should take some time and contemplate the options they have between now and Sep 2011.
I can see three Options (O):
O1) "Wait and Watch" option:
This applies to folks who are either close to the PD being current or folks who are on EADs or folks who are happy with their current career state
O2) "You are on your own" option:
EB-3 folks - can try find a job where the employer is ready to start their EB-2 GC process within the next 6 months (make sure your current GC application has an approved 140)
EB-2 folks - can try find a job where the employer is ready to start their EB-1 GC process
O3) "We are in this together" option
All EB-2 and EB-3 folks sign up for a concerted effort where IV leadership is in the driver's seat.
Each one of us should be able to relate to one combination of Group/Member/Option (GMOs) from the above list.

Kudos to you for waiting patiently since 2002, hopefully 2007 fiasco helped you to get an EAD. If not, more kudos to you for waiting.
I see that you are a one-time donor...ever considered signing up for recurring donations - minimal of 25 USD for 6 months?
The reason why recurring donations are more effective is that it will give IV leadership some cushion to plan their advocacy activities in the near future - for our sake! I know people get turned off when some one asks for money and there is no visibility into the spending practices.
Think of it this way - If we can afford 5-6 USD per week without visibility then we should consider signing up for this minimal recurring contribution.

I think I may have missed by a day! My PD is May 8th 06. I didn't see the section in the pdf that says PDs upto 15th will be considered?

It clearly says, when DOS write cutoff date as 8th, all applications with priority date 8th-14th are included.

Sep 09 VB for EB2-I was Jan 2005.
Oct 09 VB for EB-I was Feb 2005.
Last year the dates for Eb2-I didnot retrogress.
Going by that, I strongly believe Oct 10 VB for Eb2-I won't retrogress either.
Also if you consider that Sep 10 VB for Eb2-I moved by only 2 months, I am thinking USCIS wants to consume all spillovers so that dates don't retrogress. This supports my theory

I would open a SR first and depending upon the response of the SR
1. i would open a SR on the first working of September
2. take an info pass around 15 th of September (just to see whether the October visa bulletin dates are we still current or retrogress back and depending upon that go to info pass. If my date is current for October 2010 i will go to info pass late September)
3. If you have date current in October visa bulletin also and if you have already done steps 1 and 2 and still waiting for the GC i would contact the local senator or congress man and submit the immigration inquiry.

It looks like that section only applies for determining cutoff dates. So only those whose PDs before May 8th,2006 are eligible to get GC in Sept2010.
In that document, basically it states that grouping is used for determining the cutoff date. Group itself is not cutoff date. How it works is like this
say total visas available are 2000 and if they include group 1 (1st-7th dates) and the demand is 1500 and if they include group 2 (8th-14th) demand becomes 2100, then they will set the cutoff date as 1st.
on the contrary say if even after including group 2, demand is less than 2000, then they will set the cutoff date as 15th.

I agree . CIS and DOS now have a better set of numbers and last one year we are not seeing wild back and forth movement as we used to see earlier.
Given the trend I am guessing my PD (Mar 2008) will be current by July/August 2012.

That was my impression too from the language used in the monthly bulletins.....I think only the PDs upto May 7th will be current

I would open a SR first and depending upon the response of the SR
1. i would open a SR on the first working of September

Since the fiscal year is over (with September), usually October/November/December months may not see much movement. One should consider themselves if they do not retrogress. With no retrogression then chances of moving forward is a good possibilty. Else the wait will be near for an year, at least 6 months.....

Not all with PD in April will be given a GC because USCIS is not reliable and do not promise to issue a GC. I got my GC and my friend whose PD is nov is still waiting. If in Oct 2010 the PD retros to April 1st then people after april 2nd should forget about getting a GC.
So when Sept 1st comes do as much as you can to get your GC approved.
I mean (Infopass, Congressman, Senator).
Do not do SR because they may come back to you and say that we will give you a decision in 30 days and after that the Congressman would not be able to do anything either because the USCIS system will reflect the SR and the Congressman will tell you the same.

Several members here (including me)has opened SRs and got it serviced.
Interview for I-485 is a possibility for anyone.

Without SR how can you take INFOPASS appointment? You need SR ID to get INFOPASS appointment. Don't you? Am I missing something?
I see only Case Services follow-up appointment which says the following
"If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment. "
Look for local congress man/ senators office and talk to them about your case.
Most of the senators/ congress mans office they have a form and if you give your details and and related 485 information. they will write a letter to service center and wait for their feed back. it is quite fast if it is from senator/congress mans office.
try to find out who is your senator. and this senator should have local offices in almost all the medium cities if not try to look for near by office and go in person.

There is possibility that the dates retrogress. But they won't go back a lot though. Last year, the dates moved from Oct 03 to Jan 05 and then stayed because there were not lot of cases to be approved in volume as compared to what we have now. If USCIS clears all the backlog till Mar 06 or April 06 then the dates may stay. But if USCIS does not approve all cases between March 05 to March 06 then there is good possibility that the dates may go back to 2005. I think it will all depend on efficiency of USCIS.

I am not scaring you guys.
But............
Not all with PD in April will be given a GC because USCIS is not reliable and do not promise to issue a GC. I got my GC and my friend whose PD is nov is still waiting. If in Oct 2010 the PD retros to April 1st then people after april 2nd should forget about getting a GC.
So when Sept 1st comes do as much as you can to get your GC approved.
I mean (Infopass, Congressman, Senator).
Do not do SR because they may come back to you and say that we will give you a decision in 30 days and after that the Congressman would not be able to do anything either because the USCIS system will reflect the SR and the Congressman will tell you the same.
Please don't encourage to flood the system and scare hell of everyone, i know many folks are still waiting from EB2 2005 yet many 2006's were approved , I am very certain that congressman's letter is nothing but waste of time. many of folks are getting without any efforts.

When the priority date reads May 08 - it means all applications 'PRIOR' to May 08 is included - that does not include PD applications falling on May 08.
What the pdf tells is that days 1 - 7 is clubbed under 8th , days 8 - 15 under 16th etc - that is immaterial to us - what matters to us is if our date falls before the cut-off date or not. Hope it is clear - even if it is not - please take it .. I did spend 2 hours last month at work researching this ! So bad news buddy ... until next time.

* People can file in EB1C under the name of managers
All it matters is, EB2-I should not move. It is okay not to have movement in EB3-I. But make sure there is no movement in EB2-I. If someone cries in EB2-I that there no date movement, then make sure to use your foul mouth.
WHAT the *** are you EB2 guys crying about. EB3 India has not moved a DAY!
This is bloody frustrating!

I agree . CIS and DOS now have a better set of numbers and last one year we are not seeing wild back and forth movement as we used to see earlier.
Given the trend I am guessing my PD (Mar 2008) will be current by July/August 2012.
Let's say they hit July'07 next year this time, then they do not have any more pending inventory of I-485's to move PD. They will then have to make it 'C' and then retrogress it back to July'07. We will then see a slow movement again. That is my take.., hopefully this happens.

It is upto each individual to take what ever route they want. Either take my route or something else.
I am showing a path but not trying to create panic.
You are certain that congressman's letter is waste, but I have a story to tell.
My friend who works with me went to the congressman of his area, the congressman spoke with the IO at USCIS and asked the IO to take care of the case. This congressman
did not issue a letter to take to USCIS or fax it to them. He spoke to an IO and his
immigration rep followed up with the case and in five days he was approved.
Bottom line......
No harm in trying.

Without SR how can you take INFOPASS appointment? You need SR ID to get INFOPASS appointment. Don't you? Am I missing something?
I see only Case Services follow-up appointment which says the following
"If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment. "
NO SR ID is needed. You go to the infopass appointment page and register and get and appointment date.
SR is opened with USCIS not with the local office.

I met one Sr. Lawyer one year back and discussed about Priority dates.
Priority dates are only meant for filing fresh I 485. But it is not a Rule to not approve I 485.
But it is a guide line their employees to those applications get process.
At the same time in the last month / Quarter they can approve I 485s those are not current as per Visa Bulletin.
This rule is flexible for them to avoid Visa number wastage.
I do not want to give wrong hopes. But want to share info that what I heard.

Actually that's is not entirely right.. even the most rabid anti-immigrant congressman is first and foremost a politician..!
You do contact him.. make him realize you exist and soon your kids and your family is going to be voting in his district.. ! the calculations change once folks realize what is going on.. most of these hatriots who are on anti-immigrant bandwagon are really just out of votes.. tea party types and the children of john tanton (look him up) have scared up republican base and turned it into mean , racist party.. more ppl like you speak up.. harder it is going to be for these congressmen to ignore you..!
So speak up.. and be counted..

That is very true, We have seen many cases approved even priority dates are not current. Thanks for clarification.

Chill out.. No one here complained that EB2-I is moving faster, Who told you that it is OK to have NO movement for EB3.
h1b_morrisville was frustrated that his priority date was not current (Feb' 02) as predicted by VB.
Now Since EB2 is moving does it go until 2007 July (july fiasco dates) and than Visa Numbers starts spilling over to eb3?
Or does it get current till 2010 and then Visa Numbers starts spilling over to EB3...
Or is it just wishful thinking they have some criteria which even they don't know :)
