There is a ton of threads on FBI name check but i was not able to find a answer to this question.

If your name is stuck in name check after you filed 485 and if you go back to ur home country for H1/H4 Visa stamping (renewal) with new PIMS system in place do you have problems with stamping .....

Does name check creates issues with H1/H4 renewals ???

Please suggest.

Thanks

FBI Name checks wont create issues with H1/H4.

Please check the following URL and you will understand everything.

Based on my personal experience there is no impact. I have renewed H1 once in India and subsequently used AP 3 times, i have had no problems at all.

Please note that even at consulates they run your name in their system. If you are stuck in namecheck at 485 level, it means there is a hit on the name. The database they check against is same. It is likely that there will be a hit there as well and consulates DO initiate namechecks before issuing the visa.

That being said, your namecheck thru 485 is independent of your application process at the consulate for visa stamping. Now, if somehow they don't get a hit on your name, you will be fine.

Were you stuck with namecheck in your 485 during the time you applied for H1 stamp at the consulate?

yes, i was. I was stuck for 3.5 years, i just came out of that hell hole. Many people have no idea they are stuck in name check and they renew visas. Frankly, if you dont have any convictions(major or minor) you should not worry about it. I did not even have a traffic ticket. 485 name check is different from the the one for visa renewal at the consulate, one doesnt have a bearing on the other.

I am stuck in namecheck for my I-485 (PD is current now) and am stuck in New Delhi consulate under "AAP - aka Security/Name Check" while trying to get my H1B revalidation stamp. I don't know if these are related - just wanted to bring it to attention

You should have taken AP instead of going thru the revalidation stamp while your AOS pending.

How long is your NC pending >180 days??
