View Full Version : What happens after 180 days of RD?

Hi everyone,

In light of the recent FBI name check memo, What exactly happens to the I-485 now after 180 days have elapsed since the RD? Does the case get transferred to the local office? Or does it still stay at the TSC/NSC? My PD is not current though.

From what I had heard earlier, once ur FBI name check was done, regardless of whether ur PD was current or not, the cases were transferred to the local office.

Can some experienced people answer this question?

Nothing happens as such.
Before this memo. USCIS would not process otherwise approvable cases if Name check was pending..
After this memo.. USCIS WILL approve otherwise approvable cases IF name check is pending for more 180 days.
All other processing remains the same..

So ur saying that the cases were never being transferred to the local center? I keep hearing on here that "my case was transferred to the local office" what cases are these?

These are the cases where there may be some issue and they will call you for personal interview with all the documents. I think their are very few cases like that, maybe around 1%.

That's what I think too.....however whenever I ask the Immigration officer at the Infopass, she tells me that the case will be transferred to the local office for interview purposes..but I dont feel so. She must have either mistaken me for a family-based green card applicant OR she's not sure of what she's saying..I dont know it confuses me at times as I've heard 2 officers state the same thing and everywhere else on the forums it says otherwise

Just to add - after Jul 07 incident more and more people are being called for in person interview. I was one of them who was called for interview for no reason. Although they asked for a lot of documents like pay stub, w-2m job profile, residence address proof etc etc. At the end of interview I was told that case is approvable and will be approved once visa# is available.

My LC was cleared in Nov 06 and I had filed for 485 on Jul 2 2007. Interview was in Feb 08. Now all I can do is ,,,,,,,,,,WAIT for visa bulletin to show CURRENT for EB2 category....
