I always loved this board for what it does - especially the Gurus who always spend their precious time giving input to member's queries. Well... this is not query. I just want to vent my frustration, helplessness to fellow friends in this board. In spite of graduating from a reputed univ with a Masters and very good GPA and also having 7 years of professional experience, I am bound to be a slave to my current Employer without any promotions, career growth or anything remote to that for next (God knows how many Decades) several years. ppl who are junior to me in every aspect are growing left and right and are also getting brighter opportunities. I dont care if you guys think I am jealous of them.... But does God really exist ? sorry for wasting your time with this depressing note. I guess there is a limit to how unlucky I can be !! call me a cry baby but I am one real unlucky individual !

There is always a silver lining in the black clouds. Do not despair. Believe in GOD AND YOURSELF. Rest all will fall in place. Can you explain what's going on?

EB3 I-140 approved - priority date 2006. no growth/promotions. Cannot switch to another Employer as I am close to 7th year on H1B. I am now officially a (white collar) slave.
Can't agree less with you. You describe bosses too well. Look for another job and switch ;). Live a KING's life not of a Slave.

thats the problem.... I cannot switch to another job as I am in the 7th year of H1B and I-140 approved but did not apply for I-485 yet. friends told me its risky to switch jobs now as I may be out of status.

Boss, I was exactly in same position as yours. You can call it a mirror image. I switched in 9th yr of h1 after being a white collar slave with same employer. I'll suggest before you loose self respect and confidence in your own eyes..... SWITCH.

Thanks SGP. Did I read this correctly ? you switched in 9th yr of h1 ? was ur I-485 pending or did u have EAD to change ? I just have I-140 approved. so if I change to a new job now, can the new employer use this old I-140 for extensions ? can new employer ask USCIS to port old priority date ?

You can still get promoted while on H1B just don't give up hope. If you're not getting promoted even if you're performing well, then there's something fishy going on with your employer.

true, my green card was filled EB 3 Software Engineer, today I am an architect, jumped 3 level up . I dont know why you can't get promoted.
You can still get promoted while on H1B just don't give up hope. If you're not getting promoted even if you're performing well, then there's something fishy going on with your employer.

floridasun: Yes, you are reading it right. I switched in the 9th yr of H1. As you can see from my signature I am yet waiting to apply for I-485. I have an approved I140 based on which I switched from Company A to Company B. The only things I had to do was transfer H1 to Company B and start New Labor. Once new labor is approved then, will have to do New I-140. You can ask USCIS for old priority date at the stage when you apply for new I-140. The new labor and I-140 can take anywhere between 6 to 8 months. Your old employer cannot revoke your approved I-140. Make sure that you have the copy of the approved I-140 before you quit.
Don't worry go for it. I know what it feels like.

No problem my friend. You are welcome. I am glad I was able to help you.
Company A CANNOT revoke approved I-140. I have checked this with 3 to 4 attorneys & also with Gurus on this forum. Only the USCIS has the authority to cancel the approved I-140, if it detects that it was obtained fraudulently.
One more suggestion, ask company B to file your H1 with Premium processing. Once you get H1 approval then submit resignation to Company A.

Actually, I believe that if the promotion is a "natural progression of the job ladder", you can accept it. What you cannot do is change the job ladder completely to a different track.
Thus, say you filed labor when a software engineer, its ok to be promoted to "Senior Software Engineer. What is not ok is to change tracks to say "Product Manager" or a position as "Sales lead" etc...
Of course, i'm not a lawyer, but this is what i;ve been told by other folks and lawyers at my company.

1) Show me that no more than 90% of the population experience depression tendencies at some point in their life.
among EB applicants I believe it would be 99%. So are you alone? I guess not:D:D
Things you could do: Try watching talks with the Dalai Lama (available on youtube). Read books on Gandhi. Increase frequency of quiteness / meditation. Watch atleast one comedy show per day. Visit/remember the sick/disabled/poor or other less fortunate people than you.
Things you could avoid: Heavy drinking. Watching news, movies/shows which are high tension. Most important is not to fight the emotions/thoughts that you consider are destructive. Allow them to come and go. Just watch them come and go........
What you consider as "Good luck" can happen to you in the fraction of a seccond, however, it will never happen if you keep on defining yourself as unlucky. So focus on the good things you have now and refrain from comparing to "what you should be having or are worthy of having". :D:D:D:D

thomachan72.... good advice - your point taken. I follow similar techniques to stay optimistic for most part of time. but every once in a while, there comes a time when I think why do some ppl get so lucky in everything they do.... they succeed in everything they do. while there are unlucky ppl like the poor/disabled etc who are destined to live unfortunate life deprived of so many things that other ppl enjoy regularly. is this what they call 'Law of Karma' ? did I do anything bad/evil in my past births - did I destroy anyone's career or life ? I am positive I did not do anything bad/evil in this life .... atleast as of now :D

Job Change - Transfer of Original Priority Date
This is not related to AC21 portability. This is very useful in a case you are planning to change jobs or you fear that your employer may be thinking about laying you off or firing you.
If the person has an approved I-140, but I-485 is not filed during priority date not being current, and decides to change the job, either with the same employer for a different job or with a new employer in a new position, the green card case would have to be started all over again, including labor certification(if required), I-140 and I-485 (or consular processing). However, if the person had an approved I-140 from the previous job, it is possible to request to retain the priority date in a new I-140 petition.
You can change jobs when I140 is approved and I485 not filed but the new employer will have to start GC process from scratch, but you can retain old PD. You can also check with attorney if you are still doubtful.

You are not alone in this situation...I switched couple months back while I am on 11th yr
H1B. I was with same employer for 8 yrs and applied for 140/485 but both got denied as attorney made a mistake in labor and 140 stating that I will be working only from my employers chicago office and eventually my employer closed chicago office before my 140approval and USCIS raised RFE for that and denied stating that my application is no longer eligible due to closure of office....So I hired an new attorney and filed appeal. Meanwhile I started all over again with another employer and got new labor/140 approved and switched recently. Now I am on 11'th yr H1B.
Now to answer ur question on what if previous employer revokes your approved 140, it will not effect and you can still retain and port the PD to the new employer at the time of filing a new 140 with another employer....what that means is that you can still switch the employers and still retain ur PD

Very unexpectedly, just last year in a hospital, the doctor told me that unless I get operated ASAP, there is not much chance for me to live. As I was still trying to digest that news, I was thinking...
***k the Green card. ***k my job. I just want to live few more years until my son grows to at least 18 (he was just 1-and-a-half at that time).
And I really laugh about the whole incident now. And when I see others vent or getting upset about something, I can't help but get a smile. Because I learnt the hard way that we never appreciate what we have got and always complains about what we haven't got.
It's New Year time!! Enjoy and cherish your presence. And forget about the job/visa for a day or two.

I agree with you Punjabi, I just got an car accident awhile back and thought the same thing like you. even a NORMAL situation is a blessing. we should always appreciate everything that we have and then from there maybe all the things that we always want will come by themselves.

I know exactly how you feel because I felt that way every single day for over 8 years (look at my priority date) and even years before I sent in my i485 application. It is just the worst feeling of hopelessness and constant worry because you don't know what's going to happen and when is it going to happen, and you can't even do anything with your life because you don't know the outcome of the whole thing. I know exactly how you feel. I finally got my GC this year but I think what I went through I will never forget. I hate it when people try to make others feel better with story examples of unfortunate people from poor countries or alcoholic parents or whatever stuff of that kind, because no one who is going through something so emotionally charged as feeling like a caged bird with no future is going to take those examples and all of a sudden go AHA and feel happy, however, as someone who was where you are and who waited for over a decade to get to the final point, I can tell you what I now know I should have done while I was waiting. I should have learned a language, I should have read more, I should have acquired more hobbies, I should have learned some extra computer skills. I finally got my card and I have to start from zero because I spent so much time just concentrating on my job and my misery and on other superficial things, and now, in order to finally move on I am home on the 1st of the year surrounded be a million "how to" books in order to be able to learn new things and get a better job that is obviously going to require more skills. The only thing I give myself credit for is starting an "after GC goals" list, because I have been doing things I always wanted to do and enjoying it, and crossing them off my list.
Also, I don't think you're really being jealous, I think you're just upset that other people with similar or less skills than you get to move on to better things, and that's really, very normal. I was there too, and tons of people on here go through the same thing. Life is unfair that way sometimes and it's all about how you make your lemonade out of lemons. So, my advice to you again is to use this waiting time to learn new things, even if you practice calligraphy, just keep busy, do something, so when you finally reach the end of the line you can say, f this, this took forever, but at least I don't feel like a damn loser.

Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. This dumb wothless piece of $hit doesnt know how hard (impossible ?) to get GC in this lifetime becoz she got it in 6 months :mad: .

Yeah, and that's another thing. There are a lot of insensitive people out there who don't really know the meaning of sympathy and who think out of their butts. That is why when you feel like venting out you need to really select people that are more compassionate. No one expects a pity party, but at the same time no one should trivialize something as serious as this or give "advice" that is idiotic and that even they, had they been in this situation, would not do. I feel terrible for your friend because he has such education and is stuck like this. It feels like you're wasting the best years of your life just waiting. There is nothing that I or anyone can tell you or your friend to make you feel better but please listen to me and learn from my mistake, and tell your friend, too: DON'T WASTE THIS TIME. If you need to volunteer somewhere to use skills that you have that you are not allowed to use on your present job, DO IT. Or if you can take classes to learn new skills, DO IT. Find a way to be more than what you are now so that when this is over you are not just "floridasun, man stuck in the same job for 10 years" When you finally get out of this hell hole and someone looks at your resume and says, what, you did this for how long!? Then you can say, well I had a special situation, however, sir, look at these other things I have done.

Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. The price of GC is what you assign to it. The value of GC is not what other people tell you it is. If you get depressed, make your life hell - it's because you chose it. My PD is 2010 in EB2 and I came here in 2004. I know what I'm getting into and it's my decision so I won't fret about it or get depressed. GC is just a document, it should not define you or your life.
Enjoy time with your Family, wife, kids - it's priceless.....a new sports car will also help. Life is a great gift and will have ups and downs....don't let GC define who you are. I rejected filing in EB3 3 years back with a big 4 consulting firm and changed jobs. I also feel this "promotion" thing but I chose to be in that position. My friends in India are all PM's and Sr PM's.....they got what they chose.
Life is decided by the choices we make, not GC. GC is just a document. Enjoy and celebrate life.

for your kind information, sorry for starting rats comparison here but I came to US about half a dozen years before you. my priority date is 2006 and EB3. also I recognize that there are ppl out there who came earlier than me too. Its very easy to preach 'Life is decided by choices we make', 'your luck/fate, success is decided by your own effort, talent', 'if you have it, ppl will notice it and you will succeed' etc. when you spend the most energetic, productive part of your life in a country, you would expect that country reward you with atleast opportunities to prove your mettle. not to say its immensely painful when ppl who came years and years after you get GC and grow leaps and bounds right in front of your eyes.
P.S. I am not questioning your qualifications or anything.

Just chill man. You're the one who was calling GC garbage can and then spending your most productive years on garbage can. Who spends his most productive years on garbage can? Obviously GC is something bigger for you.
Anyway, best of luck and have fun with familiy. Don't take too much stress...hopefully Obama will do something and everyone will have GC in 2-3 years. chill. Indians and Chinese have a disadvantage in this GC race and it affects all of us. A guy from Argentina already has GC and we applied at the same time. I also see these things around me but we can't do anything. We chose it.

He called it garbage can out of bitterness and perhaps a little sarcasm. Obviously this is very important to him, otherwise he wouldn't have vented to perfect strangers on the internet. Have you never really wanted something and lashed out at it out of frustration?

Thanks Almond. At this point, I am hoping USCIS will at least allow me to change jobs (remember - I am on 7th year H1b - approved I-140, did not apply for I-485 due to retro). some members here said this is possible and some other members said I cannot do this. so I am confused if I can do this or not. If at all USCIS lets me do this, it would be great if I can find a new employer who can do EB-2. I am praying to God to help me while I try this route. I am not asking too much here... am I ?

No, not at all. It's perfectly normal to want to advance in life and to want to move on to better things. I think the best thing to do right now would be to go for a consultation with an immigration lawyer. Or, if you cannot afford it maybe you can schedule an InfoPass appointment and ask the rep there what your options are. But I'd say a lawyer would be the best option.
