View Full Version : USCIS official predictions for EB3
Dear Admins,
If you can use your influence to to get a official predictions for EB3 from USCIS based on current data which is already public.
I just read a thread that said:
It will take 3 years for EB3 India to reach to Jan 2003.
It will take 20 years for EB3 India to reach to Jan 2010.
If we get a official letter, we can pass it on to the news media, President, Congress. Since Republicans are ruling the congress CIR may not happen, so piece meal legislations for EB is the best bet, and Republicans favour skilled legal immigrants.
Best Regards.

IV already has a detailed packet spilling out the backlog and how it is affecting EB applicants. It is now each and every members job to get hold of that and talk to our lawmakers. Member's need to take charge and educate each lawmaker on these issues.
IV also has a media packet ready, if members want to help out with talking to the media, please talk to IV media group.
IV core is already doing more than is expected of them, The need is for thousands of members to do some effort in educating the lawmakers. Just 20 core members doing the work is not enough.

USCIS does not set the cut off dates. So it will not issue this type of letter. DOS sets the date. But it sets it on the monthly data that USCIS provides.

Not sure if we can get such letter from USCIS...a better option would be to get a letter from your employer or immigration attorney saying that it'll take X number of years for your Green Card processing and if your job title changes during this time then the process has to be re-started from scratch. Good Luck!

We have all the tools and information to educate lawmakers about the delays and backlogs. IV has a detailed presentation with facts, figures and analysis. It is just a matter of making these presentations to the lawmakers.
We do not get any attention, because we do not raise our issues and we are not vocal about the problems we face. We need to educate the lawmakers about us. We face real issues and our lives have been held in limbo. We have done everything right, played by the rules, stood in the line, pay taxes, contribute to the society. To get this message across, we need to visit lawmakers offices, and educate them.
This advocacy and raising awareness is an ongoing effort, it cannot be a one day or one month thing. We will not get anywhere overnight.

In the employment category, as of now, they are giving green cards that were filed a decade ago. In the family category they want the spouses to be separated for decades, parents be separated from children & vice-versa. On the other hand they hand over 50,000 green cards in the name of diversity.
What are you going to inform the people who wrote/supported these laws ?

well its not right to blame the current lawmakers for our issues. The DV lottery was created in 1990 and many of our issues are linked to H1b hikes in the 90s and caused due to inertia in other policies that weren't implemented. It takes a lot of effort to change current laws.
Most of current law maker offices aren't even aware of our issues today. Nobody else is going to have to tell them except us, and this needs to be done by everyone.
so if we sit back, no one is going to find out about our issues.

Do you think the lawmakers know that employment based applicants are waiting patiently for more than a decade?.
These laws were written way back when- and the current crop of lawmakers have no clue.

And you thought they don't know ??? boss if you think they don't know, than you don't know anything...This is the politics that US lawmakers are playing. When you say green cards they say H1B, when you say Hi-Tech immigration they talk unsafe borders. They know every damn thing happening in USCIS, DOS, Labor depts. if you talk to them behind the closed doors the lawmaker who just told you infront of the camera that he didn't know anything about Emp. based green cards, he will be able to tell you how many Perm Labors, the Labor department approved in 2010, 2009, 2008....they are anything but ignorant about our issue. They just don't want to do anything about it.

If so frustrated by system are you thinking going back?
Or withdraw application?
Everyone made choice by applying. Nobody force.

Which sentence of mine tells you that I want to go back or withdraw the application ? It is a genuine frustration, and I don't think I am the only one being frustrated ? but why are you drawing weird inferences ? Also it is true nobody forced us to apply for the green card, but shouldn't the public policies be for public ? What is the point in making the permanent residency so complicated that it screws the family and careers of people ? If so frustrated by system are you thinking going back?

This is a misconception that they don't care about legal immigrants. This is also used by members as a reason for procastinating on meeting law makers. kind of accepting defeat without any effort. Procastination.
Which one could it be ? Types of Procrastination - wikipedia (http://en.wikipedia.org/wiki/Procrastination#Types_of_procrastinators)
They don't have any hidden agenda per se, to harm legal immigrants. its not possible that more than 500 law makers all over the country decide on a secret agenda.
They are elected and just like others can lose their job if they don't perform. some people even think that the govt is all made of naz*s with a superiority complex that is untrue.
Their staff are very polite and approachable when you meet and call them and its their job to fix your problems.
charles oppenheim is from DOS and he doesn't have a say in laws and only follows what govt. passes through senators, house reps.
As mentioned before, even the president cannot guarantee a law will be changed or passed unless it clears senate and house. So lets not try to predict it ourselves.

We all know when applied. USCIS or Government does not promise Greencard in 6 months. So our choice and our price to pay. Like it or go back. Why crib is I am saying. You cannot blame politicians for it. They made law. Now more people come and quota limited. If coming made easy more people come. H1B L1B allows more people come. EB3 is mostly Bach. degree. For people with PhD wait is very less. As country America needs bright. If they start allow unskilled and low skilled all world will want come to USA.

They did not promise 6 months, I agree, but 10 years wait is not human either..moreover read my first post, I was cribbing about the 50K greencards given on DV lottery. If only PHDs or capability to contribute to the country was the only criteria, I wouldn't have complained but here people get green card in lotteries while in sleep, and other get just by virtue of place of birth. It is certainly not a fair system...As per your information you are EB-1 China. So in the first place I have no clue why you are in this forum, secondly to feel the pain, you need to bleed..you are just watching a horror movie and posting comments with popcorns in one and a drink in other hand.

dude you dont even seem to get the problem or why so many ppl including myself are venting frustration here in IV for GC... I will not explain everything to you but for a start, EB3 is mostly Bach. degree only in theory... most of the advanced degree holders such as MS are also bundled up as slaves in EB3. basically Companies say we do not need MS or 5 years - this is a very polished way of saying we want your a$$ enslaved to us for next hmmm how many ever years we need you.

When I read your post, I am reminded of a story related to the French Revolution --
When the hungry farmers screamed with tears in their eyes and babies in their arms (in the frightful cold), "We want bread and there isn't any!", the arrogant Queen Marie Antoinnette shouted back at her ministers, "What if there is no bread, let them eat cakes and sugar"!
My dear friend, if you are in a comfortable position, enjoy your luck! Even if you connot sympathize, try to empathize. There is nothing gained, except sadistic pleasure, in provoking people who have lived here for several years, undergoing so many tensions and turmoils with their jobs and their personal responsilbilities! Nothing should really bother you, if people vent out their feelings, whether they are simple folks in EB3 / EB2 or Einsteins!
Sun always does not shine, for everyone! History has seen even mighty empires collapse due to arrogance. Let us not try to humiliate, insult or take pleasure in the suffering of others! May GOD Bless You!

USCIS does not provide it, but DOS does - its called Visa Bulletin
I just read a thread that said:

It is another IV member giving his opinion. That does not make it a fact!

Take the current Visa Bulletin (the official one from State Dept), meet with the Republican lawmakers asking them to sponsor a piece meal legislation for EB

If EB3I gets only 2800 visa per year and for a person with priority date of Oct 2005 with 35000 apps ahead of him and no hopes of spillover visa the wait for that person is 35000/2800 = 12.5 years and that is a mathamatical FACT not an Opinion
Of course i say wait because there is no reason that the persons app will be picked up when he is current in 12.5 years so 3 years wait for 2003 and 20 years wait for 2010 for a person in EB3I is a FACT

Can you state what the piece meal legislation for Eb will be and how will EB3 backlog be reduced by legislations.

Congress should already know about the massive delays facing EB2/3 categories because the CIS Ombudsman 2010 report discusses them and tells them pass legislation...maybe they just don't read the report

India EB3 folks if your PD is after July 2002 don't waste your time waiting for any law or CIR to be passed. There will be no relief for legal or illegal immigrants till unemployment will remain high in USA - which will remain for a long time.
Port over to EB2 whatever the cost. dont fall for this CIR/Relief for legals Bill crap... Just upgrade to EB2 and get your green card soon. It is not worth the wait

There are two ways I see this line moving. First(preferable) way is if the economy starts growing gangbusters like in the second Clinton term and we get 3 million jobs a year. IF that were to happen then I think we might see a bill to ease the plight a year or two down the road.
Next, more sinister way is that the economy tanks, and those of you with truly sticky jobs, will be left standing. If there are very few entrants for H1b or otherwise like in 2008/9 then 140K goes a long way to clearing the backlog, especially if some drop out of line and few join/jump ahead due to chargability.
Sadly this muddling of the economy will get little to no change and with that limbo is all it will be. In this scenario the best advise one can give is to move on with you life. Forget about it. I know it is easier said than done but what is the option. Always remember whatever way you choose to live your life, your time on this earth is limited.
The worst part as I see it is that this country faces a high unemployment rate at the same time as it does a skills deficit. This is not good for its future. I hope they can address this soon.

Even Linus Torvalds (the founder of Linux) filed his GC under EB 2 . Imagine if he was from India or China how long he would have to wait. And I bet you a dollar that he is more desired in US than a so called PhD.
BTW, you do not blame politician ... right , but what about the officials who wasted thousands of EB visas over years due to their inefficiency ? Who is responsible for that ? Some PhD , I guess

hi hello hello,, just go and see previous posts from this dude black tongue. usually his/her posts will be to provocate people and u will see he/she will keep advicing others to go back. this dude is so pathetic, that he cannot even take up we discussing options and he cant hold his horses back and comes to the forum to spill venom. trust me this guy is so frustrated and looking at his/her english, I would think long and hard if this person will be in eb1. he/she cannot even write a complete sentence without a single grammatical error. so, the best way to handle this person would be "to neglect him/her".
