Hi,

I know once I140 is approved you can request 3 years H1B extension.

Suppose if one has EAP/AP approved, but not using them. He still contiue on H1B extns, can he be eligible to get 3 years H1B extn ?

You will get 3 years unless CIS gives you 1 year . Some time they do approve 1 year only by mistakes. That is what I learnt from other forums.

One of friend told me that it is beyond 6 yr H1B. If anyone has used 5 yr H1B and wants to extend beyond it, he/she will get 1 yr extension even if I140 is approved. Is this correct?

Also, does I140 need to be approved at the time of applying H1B or at the time of approving H1B?
