View Full Version : I-140 / Experience Letter Wrong - Pls help

Hello Folks-
I'm in my 8th h1b and did a concurrent i140/i485 filing in Aug 2007. I just happened to check with GC documents and found a major issue with my experience letter from my previous company. I joined company B in March 2006 and my previous companies experience letter is Dated November 2006 and states I worked with them from April 2001 to date (date on letter head)
I guess it was a typo or something and noone really noticed during the fiasco.
Will this cause me big time trouble ? What are my options. Is there a way I can file an amendment or something...
Can you please help me folks with your input.

You should get RFE from USCIS if they notice...

Will it be safe to send the correct letter now. It was very stupid of my for not having caught it during filing.

In case if it gets rejected without RFE, my I-485 will also get rejected. When I do a MTR / appeal on I140, can I also do it on I485 ? (My priority date is not current ).

I'm just trying to work out my options.

Hey Dont worry too much. Wait for the RFE. They will most likely send you an RFE or Intent to Deny. Its not a very thoughtful thing to send them without their asking you.

Infact, i got a query on my i-140 regarding the same.

Job Title not matching the Exp. Letter. You just have to explain it and you should be fine.

First. You might not get an RFE
Second. Even if you get one, you can always respond to the RFE and it will be approved.

From the forums I'm seeing lot of postings about I140 rejection without RFE's. That got me worried.

Incase if there is a rejection and I do a MTR, Will i loose my 485/EAD/AP or can I do a MTR on that also ?
