Your lawyer is right. You need one single degree evaluation that match your labor requirements for education. Experience not included for education requirements.

I did my three years diploma (polytechnic) and three years engineering degree (B.E.) after that and I had @ eight years of experience while I had applied for GC through EB2 category. I had no problem in getting my I-140 approval; so far I have not received single rfe.

I had same situation as vactorboy but I had US masters. I had no problem with labor or I-140. My I-140 was approved in a month.

My Employer has going to file for I-140 under EB2 catogery. I got Labor approved, but I just got call from my Lawer, he was saying that my Education is not being equivalent as US Graduation. He was saying that for GC we can't use work experiance to make this equivalent.

Please advice, what to do?

Here are the details about my education.

Education:
Matriculation : 10 years education
Intermediate : 3 years Diploma (Associate Engineer)
Graduation : 3 years Degree (Comp. Science.)

Experiance:
Aprox. 8 years

Shujaat, you might be better off in being safe than sorry. I've read in the forums that US CIS is strictly interpreting EB-2 regulation so you might be better of in going with EB-3. For EB-2 they prefer single four year degree. Your lawyer would know the best.

Thanks, So what was your job requirement? Was that Bachelors?

Can you tell me that which education evaluator you use for that? I might can refer my lawyer to him.

I had my diploma in Mechanical engineering (3 - Years) and B.E. in mechanical engineering. My job requirements were Bachelor's Degree plus five years experience. I don’t remember evaluations agency name now but I will get that for you tomorrow.

Sorry for high jacking the thread but I wanted some info on eb2 perm and greencard over all

My qualifications are

Bachelors in engineering - 4 years
Masters in computer science - 2 years in US

Experience of 6 years in software dev

My job requires BS+5 years only , Masters in not a requirement.

Can I file in EB2 ...could you please elaborate your experience in eb2 .

Your experience obtained should be prior to filing of labor and should be for atleast five years. Then it is okay for you to go for EB2

send your all your transcripts to www.wes.org and ask them to evaluate your transcripts. They will confirm whether your education is equivalent to US Education or not.

My wife had a BA (3 years) and BEd (1 year) and after the evaluation, they considered it equivalent to a 4 year US degree with Bachelors degree.

Based on what you said, the lawyer is right, however you can use the EB2 stream using the BS+5 years requirement, rather than the MS requirement.

Yes You Can.My 140 is still pending in EB2 category.

Mine is BE-4 Years
7 Years Experience in Indian Branch Office of the current Company + Approx 9 months outside this company.

I just spoke to my lawyer. We are considering another point that my high schooling is for 13 years, so if we highlight that in evaluation along with 3 years Bachelor then it might serve the purpose.

USCIS accepts 3 years Bachelor from UK and New Zeland as equivelent to US 4 years, cuz these countries have 13 years high schooling. In my case due to my 3 years diploma(polytechnic) before bachelor, make my 13 years high schooling. Still exploring different points.

Have anyone earlier faced this scenerio? if yes, please share the possibilities.

Be very careful while drafting your response and choose the right eval agency. I ur case in Nebraska?

Can you share you EE copy with me? It will really help me to understand that on which basis your evaluation has done.. Either 13 years schooling and 3 year Bachelor equivelent to US Bachelor...
