Qucik update: Just received my cards in the mail. No email, no text about CPO after the decision email. There were two LUDs on the application though.
Oct 14: decision email
Oct 18: LUD. decision text changed date to Oct 18
Oct 20: LUD and Cards are in the mailbox today.
Although decision email said ADIT processing etc I did not receive any FP notice.
Good luck to you all. I will be back tomorrow to call the reps on 3012..:D

not sure for PWMBs. I hv FP next month. and looking at the no of visas per yr, it seems we will get a chance of having a GC in hand next yr only.

Mine is May 2007 date and no update on my case yet even after raising a service request.
Went ahead and contacted my local senator yesterday so i do not believe everyone with priority date before July 2007 will get that this month.

Finally got greened yesterday after a long wait for 4 years.
Thanks all for all your support and knowledge for the past 4 years.
Mine is May 2007 date and no update on my case yet even after raising a service request.

Thanks for posting and many congratulations. Friends the demand data for the Nov bulletin kind of indicates that everyone who is preadjudicated and has a PD prior to 15th Jul should get approved. 5-6K numbers which is virtually India and China's allocation will be consumed in October itself.

Here is a chart for all, this is just out of my gut feel, but next movement should be the final one for the year.
1 Dec 2007 - 100%
1 JAN 2008 - 60-75% (Likely)
1 FEB 2008 - 20-30%
1 MAR - 10%

Use the following guidelines when you prepare your check or other financial institution located in the United States and must be payable in U.S. currency; and
1. The check or the money order must be drawn on a bank or other financial institution located in the United States and must be payable in U.S. currency; and
2. Make the check or money order payable to the U.S. Department of Homeland Security, unless:
A. If you live in Guam, make it payable to Treasurer of Guam.
B. If you live in the U.S. Virgin Islands, make it payable to Commissioner of Finance of the Virgin Islands.
NOTE: Effective July 30, 2007, if you file your Form I-485, no additional fee is required to also file an application for employment authorization on Form-I-765, Application for Employment Document, and/or advance parole on Form I-131, Application for Travel Document. You may file these forms together. If you choose to file Form I-765 and/or Form I-131 separately after the effective date, you must also submit a copy of your form I-797C, Notice of Action, receipt as evidence of the filing of Form - I-485.
NOTE: Please spell out U.S. Department of Homeland Security; do not use the initials like "USDHS" or "DHS".

A friend here is a brief snapshot of the current situation. The projection remains unaltered. Everyone in 2007 will definitely get a chance at 485 filing, Q1 2008 folks are borderline. The movement most likely will happen in the next bulletin itself. Then they can retrogress the date or keep it there with no approvals, but Jul 15th seems to be a very stable point, dates won't go before that point.
- Everyone preadjudicated is getting approved. This means 5.6K the I/C cap is consumed.
- This year SOFAD may range from 20-25K it will be likely lesser than last year.
- Porting approvals and EB2 ROW and EB1 are also coming in steadily.

I will maintain my old prediction for now, everyone till end of Oct 2007 will get approved. When exactly the approvals will happen depend on how many numbers are allocated by USCIS / DOS. Most likely approvals will take 6 months (Start of Q4) however if USCIS / DOS continue to allocate numbers freely or there is quarterly spillover the approvals can even come in 2-3 months.

Though I got approved last week for my GC but would like to thank Teddy and bunch of other folks who did close to accurate calculations and help keep folks hope alive without which wait seems very longer.

It will happen next year, this year the line will be drawn up somewhere early in Q1 2008, I believe all 2007 folks will be able to file this year. Good luck to all Q1 2008 folks this zone is borderline any further movement may entirely be the agencies discretion but numerically looks very less likely.

Friends the model of movement followed thus far resembles the FB model which is take demand in the first 3 months and retro. So in theory the next bulletin should be the last intake, the dates cannot be sustained at the current levels for long. Likewise the next iteration will come in Oct - Dec 2012 as Krish has commented. Let’s all hope for the best for the Dec bulletin.

How much time does it take to get the Parole Document and EAD after the priority date becomes current.
I checked the processing times on USCIS Site and it shows 3 months. I guess that's the worst case scenario.

There are way too many unknowns however if the present trend continues then Oct 2013 (Very optimistic - 10%), Oct 2014 (Realistic - 80%) & Oct 2015 (Worst case - 10%)

EAD and AP issuance have a SLA of 3 months; most people should get it in this timeframe.

Unlike the last few years, the USCIS is applying the quarterly spillover this time. This is the only reason why the dates are moving and will eventually retrogress/halt from moving any more. The questions to answer are:
1. Does this mean the 2500 I/C quota for 2012 is already exhausted (since we saw approvals from applicants with Jun-07 dates)?
2. Will the dates now only move during the last three months of the 2012 fiscal year?
3. The SOFAD will be much less in the end (last quarter of 2012) since the quarterly spillover has taken effect for this year?
4. How will the dates mover forward provided the HR3012 passes?

Now question is what is the correct answer to the question "Applying with you ?" Yes or No on my wife's I-485 form ?
On my I-485 form answer to this question "Applying with you ?" is Yes. So got confused. So what is the correct answer of this question on my
wife's I-485 form ? Yes or No ? As I mentioned above I am the primary applicant.

AFAIK Applying with you should be yes on both forms (I haven’t received them yet for signature). In my case the lawyer is filling up the forms but for this question on the template we indicated yes for both me and my wife.

Thanks for your gracious offer, the current projections do not account for HR3012, if the bill passed then you can have GC in 1-1.5 years.

These are good points. 6K of this years cap has already been burnt out for the Apr15 - Jul 15 approvals this is virtually the EB2 I/C allocation.
The dates moving will be a function of how numbers are allocated and how much intake they need. Some of the trends for this year are not as favorable as last year so SOFAD may reduce from the 30K level to 20-25K. However let’s hope demand intake happens sooner so that it’s more. If HR3012 were to pass then everyone in 2008 will also get their GC this year itself and EB3 will also hit 2004.

My attorney is just another case he sent me a mail not to ask questions before he reviews. I should be getting my forms in a day or two; maybe this is the way to indicate the primary applicant. I will let you know as soon as I see my forms but if your attorney has said that don't worry. I searched but could not find anything either.

Compare to last year we have 7,782 Additional EB-1 & EB-2 ROW cases,so SOFAD for this year will be low compare to last year.
other points to consider.
1. This year data is Service Centers + field offices but for last year it was Service centers only. Any one have any comments on this?
2. people filed with PD July, Aug & Sept in EB-1 category won't get processed before sept 30th.Data indicates no.of cases for these months in 2011 is more is it indication that EB-1 filing is increased again?

Oct 2011 I-485 inventory

EB2 ROW - 10,164
Total= 24,236
EB-1 & EB-2 & Spill over from EB-5 & 4 == 85 K Visas
Last 4 months EB1 average is 1300 cases for month
Highest no.of Eb2 Row cases is in Feb'2011 around 1000 cases
If we assume above as the expected volume to be filed in next 8 months
2300 * 8 = 18,400
so 85K - 18.5K - 24.5K = 43 then SOFAD going to be 42-6K india & china EB-2 quota = 36K
last few years story is different, uscis is stream lining and clearing old cases so in 2008 & 2009 the part of Eb1 & Eb2 row quota was taken by long pending cases at the same time PERM got slowed.
In 2010 PERM processing back to normal so there may be more demand for Eb2 row. as cases with PD in 2008 -2010 was cleared.
Also Now Pending data includes cases at field offices also
Now NO more unexpected backlogs and this year GOING to BE a Clean year MAY be we surprised by more SOFAD as mentioned in above calculation?
with India & china quota if we move to June'2007.
and with 36K SOFAD PD will move beyond mid 2008 ? read below it gives a opinion that if filling is with in their expectation they keep PD steady is this not a good sign?
In 2006 & 2007 Per month we have approx. 2500 EB2 cases for india & china so we assume same number holds good for 2008 then PD should move by 14 months from June'2007.
if PD movse to Mid 2008 by feb'2012 and then uscis have enough Quota, cases & time to process these applications by sept'2012 so then they don't need to retrogress. as cases processed will get visa number and approved till mid 2008.

EB-2 China and EB-2 India. These two categories are where the most action is going to be over the next few months. Mr. Oppenheim indicated that he expects to be able to advance EB-2 China and India significantly over the next few visa bulletins. It is possible that the December 2011 Visa Bulletin would advance EB-2 India and China to at least March 1, 2008 or even further. Similar forward movement may be expected in the January 2012 and February 2012 Visa Bulletins. Mr. Oppenheim cautioned, however, that if there is high demand (number of filings) in the EB-2 category, he may hold or even retrogress towards the summer of 2012. He noted that there is usually a 4-6 month gap between filing of an I-485 adjustment application and when a visa number is actually requested and allocated — this means that EB-2 India and China I-485 applications filed in the fall will be need visa numbers in spring/summer of 2012 and this is when retrogression may happen.

I got to read my I485 application yesterday night, just sent them back to the attorney today morning. belmontboy's response is perfect and your forms are fine. Primary and secondary is noted on page # 1 of I485. Your forms are perfectly fine.

Thanks for posting. Since this commentary comes from the man himself it lends it good credibility. This is very much in line with our prediction as well that the next VB will cross 2007 atleast. Q1 2008 folks are borderline and best of luck to everyone. May force be with us and hope maximum number of people get to file for 485. Friends I urge all of you to not get carried away because the projections of the agencies keep changing very quickly often to extremes, good luck to everyone. The volume of intake is entirely discretionary however I believe they will not try to overshoot the consumption this year by a very big number because then it will prevent them from justifying the same for next year.

Thanks for posting. Since this commentary comes from the man himself it lends it good credibility. This is very much in line with our prediction as well that the next VB will cross 2007 atleast. Q1 2008 folks are borderline and best of luck to everyone. May force be with us and hope maximum number of people get to file for 485. Friends I urge all of you to not get carried away because the projections of the agencies keep changing very quickly often to extremes, good luck to everyone. The volume of intake is entirely discretionary however I believe they will not try to overshoot the consumption this year by a very big number because then it will prevent them from justifying the same for next year.

I do believe that the movement should happen in the next bulletin itself, if delayed the result will be lesser. Here is a rough chart purely out of gut feel for the Dec VB.

EB3 will move to early 2004 everyone in 2002 and 2003 will get GC. Similarly for EB2 everyone in 2008 will get GC this year itself.

Annual Limits for Immigrant Visas
Employment-based annual limit: minimum 140,000. The actual limit is calculated as 140,000 plus unused family-sponsored preferences in the previous fiscal year. For example, in 2005 there were 3,949 unused family sponsored visa numbers, so the 2006 employment preference limit was set to 143,949 (140,000 + 3,949). If nothing was left, the limit would be 140,000.
Per-country cap: 7% of the total annual family-sponsored and employment-based preference limits. If the limits are 226,000 and 140,000, respectively, the per-country limit will be 25,620, which is 7% of (226,000 + 140,000). Furthermore, the per-country cap of 25,620 is divided into family-based limit (15,820) and employment-based limit (9800).
With the passing of HR 3012, the country cap will be raised to 85% from the current limit of 7%. Considering the EB2 Category which has a cap of 28.6% of the total employment based immigration visas (40040), the maximum number of employment based visa's cannot exceed 34034 in a fiscal year for an UNRESERVED COUNTRY (ignoring any spillover visa numbers).
The advantage to backlogged countries will be:
a) A higher number of visa's available at the start of fiscal year which will lead to many more people being adjudicated at the beginning of the year.
b) The current trend of spillover adjudications will remain in place, although the impact will be subdued as compared to the recent trend of a large number of adjudications at the end of the fiscal year.
c) Prior to the law being passed the retrogressed countries, India and China, depend on the visa usage by EB1 and EB2 row for spillovers with no guarantees on the amount of spillover visas that would be received. With the new distribution, both these countries will be allocated at least 34034 visas at the beginning of the year in EB2 as well as in EB3 category.
d) The most significant impact will be to the EB3(I) category where a normalizing effect will bring EB3(C) and EB3(ROW) priority dates on par with EB3(I) priority dates pending adjudication.
e) The second most significant impact will be to the EB2(C), EB2(I) and EB2(ROW) category where a normalizing effect will bring the priority dates for all the EB2 categories within a few months of each other.
f) The EB3 category will not get any spillover visa number for at least the next 3 fiscal years (deduced from the current outstanding EB2 inventory). However if the current trend continues for EB2 applications from India, China and ROW, there will be an eventual spill over from EB2 to EB3 category.

I don't think that should matter... my wife is on H1-B as well and has her own approved labor and 140 but with a later PD but her 485 form (with me as primary applicant) was marked Yes by my attorney.
I think the Page 1 matters most where it is indicated as primary or spouse checkbox, as teddy mentioned earlier. But, do check with your attorney to ensure there wasn't any typo on their end.

There is an unseen demand from local offices that cannot be captured. This makes predictions very difficult and not very accurate. Eb3 India faced this a lot in the last few years due to 245I and other factors like fraud suspicion, crime history etc that lead to interviews. To some extent eb3 row also face this.
In iv opinion porting is not a significant number as people think. But still it is a number. The other unknown is multiple applications of i485 by people.

It is not something we do not know and have not been talking about it on forums for past many months. Dates for eb2 are definitely going to advance. How much depends on number of people who apply 485 in Eb 2 every month and people who get approved every mo th. the aim is to advance dates and build a pipeline. IV has repeatedly met with the officials with precise data and is the reason why they are building pipeline now as opposed to later in the spillover season. And it was mentioned on this forum multiple times. Please understand Fragomen and Murthy are law firms and are quoting a statement from Oppenheimer. It is in their best interest to put this information out and claim knowledge. IV is the one actually meeting with these officials but it is not in IV's interest to put this out. That is the nature of advocacy. The goals here are bigger and in the interest of the bigger goals you have to strategically choose your plan of action.
Those of us involved in advocacy realize what it takes to even move a needle in Washington. Our opposition has budget in the millions of dollars. IV barely has enough, but has a important seat at the table because of the years of dedication of the leaders and active members. So if you are benefitting from this movement or from the bill, please realize you are enjoying the ride based on a lot of people's efforts and donations here. And that is totally fine, it is intended for everyone's benefit. But it will be great to have everyone's support to get us across the finish line and is much needed.

No, HR3012 completely eliminates country limits and makes it a FIFO system. The transition rules are in place so that it is not a sudden jolt to the system when the backlog is clearing and so that all backlogged countries get relief. In the transition period 85% is FIFO in 2012 (with 70% limit for a single country) and 90% is FIFO in 2013 and 2014. After the 3 years it is 100% FIFO for all EB categories.
Needless to stay in the first few years India, China, Mexico and Philippines are the primary beneficiaries of the FIFO system as these countries are backlogged. After that, it is whoever applied first, regardless of which country. No one in a certain EB category will get a green card before anyone else with a older priority date in that EB category.

With the current pending I 485 status in OCT -2012 , India EB3 may get cleared till Dec -2004 and India EB2 may become current .

Friends I would urge all to take all postings at different places and predictions everywhere including here based on your judgment and not literally at face value. It is very kind of CO to have shared with AILA about the Dec and future VB's however there is always a time lapse between that time and when the bulletin is declared. Since the situation can change in that time it can cause swings and changes to the final outcome. I hope that the dates move in the next bulletin itself because the I140 approvals are surging and EB2 ROW and EB1 inventory is rising these do not augur well for SOFAD. However since the 01-MAR-2008 comes from the man himself I hope it materializes.

Friends following are the Other Site comparisons for 2011.
EB2 ROW 2010 - 25
EB2 ROW 2011 - 63
EB1 (A+B+C) - 2010: 8 + 6 + 5 = 19
EB1 (A+B+C) - 2011: 3 + 2 + 20 = 25
Last year’s SOFAD was 30K lets split it as EB1 - 12K, EB5 - 6K, Regular Cap - 5.5K, EB2 ROW 6.5
- EB2 ROW usage is drastically down by 60%. This could really be good for SOFAD. If this trend continues
Then EB2 could well be providing very significant SOFAD.
Let’s assume decline to be 30% instead of 60%. As smaller figures do not mean smaller scale down literally they should be factored.
EB2 ROW SOFAD will be - (40-5.5) - 70/100 (40-5.5-6.5) = 34.5 - 19.6 = 15K.
- EB1 is overall in the same range down by 25%, however looking at the figures looks like the Kazarian memo is playing havoc with EB1 A & B diminishing and EB1C growing 4 fold.
Looks like EB1 should maintain the 12K SOFAD. It’s a must that the Kazarian trend is maintained or ROW decline should compensate it.
Despite high 485 inventory and high 140 figures the Other Site trend for October is highly encouraging. This is very early days however last year this early lead was very correct. With this early trend I believe that last year’s SOFAD level may well be maintained but let’s make note that it’s an early trend and Other Site represents only a small sample of data but the great advantage is that its well organized. For October yet another explanation could be that CO is giving away EB1, EB2 ROW and EB5 excess to EB2 I/C on a monthly basis if it is literally true.
If last year’s SOFAD level is maintained then everyone in 2007 will have GC in hand by Sep 2012, however the other indicators suggest lesser movement than this. To take the Other Site trend concrete another 2 months of observation is required. The agencies IMHO must maintain 2 months as a buffer. Let’s all hope the Other Site trend holds.

Actual approvals i.e. GC in hand will range from 01-NOV-2007 to 31st Dec 2007. The Other site trend indicates the higher end for now otherwise with the wave of I140 and I485 it may well be the lower end.

These are just my personal beliefs. The movement will happen only in the Dec bulletin because definitely a wave is coming by I140 and I485.
The date range could be 01-JAN-2008 to 01-MAR-2008 (Date From CO).

Also, another query...i applied for 485 in July 2007 and got married later. Lawyer said that my wife's 485 has to be applied within 2 weeks or so of my date becoming current, else it may be an issue. Any advise? Thanks!

I agree with Teddy. If you have the option, please port your priority date. For that matter, any EB3-I/C applicants should definitely consider porting to EB2.

This one is without 3012, the progression rate is @2800 per annum. HR 3012 can drastically change things.

My priority date is Feb-2008, Hopefully it will be current by next 1~2 month. I-140 was filed with CP processing option. I have just received the email from NVC for fee payment
My question is should I continue CP processing route or change to OAS and apply for 485 as soon as priority date becomes current.
My understanding is with 485 filing, I can work permit for my wife also which will not happen with CP processing.
Since there is a good chance the PD will retrogress, I may not get actual green card fro another one year.
CP or OAS route both are probably going to take same time if the new law is passed in that case there will no be any retrogression.
Looking for your guidance

all EB3's, with PD post 2005 will have minor effect even if the bill passes. Eb3 Row has been around 2005 for a very long time even with the country quota. Try your level best to convince your company to sponser in EB2 and port the date.There is a good chance that EB2 may become current in 1 year if this bill passes.Ultimately, this is a good bill for everyone and everyone can benefit from porting to EB2

It is entirely CO's discretion how he would like to allocate numbers. Best case is 3 months and worst case is Jul - Sep 2012. In the October approvals the entire cap for I/C has been consumed, so now unless CO allocates more numbers early by quarterly spillover or other ways it will take time till May 2012 to set the ball rolling. All the best, mine has also been filed today finally. Next month is the key, if CO keeps allocating numbers then approvals will keep coming sooner. I believe all PWMB's who filed last month have had FP done so nothing left to do now its really for them to adjudicate the case.

GO for AOS without any second thoughts. This way you and family will get EAD and AP and that way you are completely safe.

Try porting without any second thoughts. The wait in EB3 is not worth it unless PD is in 2002.

It will still take 4 years. After 2005 the smooth movement will stop even after the bill passes because EB3 ROW is stuck in Dec 2005. Porting is the way to go.

Bro I saw your post yesterday and wanted to confirm my EB category though I was told it to be EB2 by my employer for the last 4 years. And found that it is EB3. Feel sorry for people like us who are cheated by employers and kept in the dark. Friends I would urge all to check their I140 approval notices. Most of us will have the following (if you are not NIW) if you are EB2. I can imagine the heartbreak.

You can ask your employer to start GC process allover again in EB2 category. I think labor are getting clear in 4 to 5 months time. And after labor gets clear, you can file your I140,I485, etc with interfiling potion.
If your employer is not ready to start your GC process in EB2 than I will strongly suggest you to change employer NOW.

I saw a couple of posts making fun of the people whose world was shaken after finding out that they are "not in Eb2 category". People question how can this happen or if they didn't read the job description..
It didn't happen to me but it happened to a close friend of mine but he was lucky that instead of Eb3 his application was done in Eb2 which is like a lucky lottery but the fact is he actually didn't know his category. Job description was never given to him because he just needed a job , any resumes was passed through people he knew(us).
I am mentioning this because when this paperwork is being done people don't realize the importance of the paperwork or may be just happy with to get a new job but it later dawns on them that GC is the key to be in the US. Sometimes it may not be even their fault. I am sure we all acted stupid at some point so when people are asking advise.. if you have something which helps them write back otherwise don't respond.

my job description was masters + 2 years and it got approved without any issues. But My I-140 was applied under EB3 because my attorney thought that was safe. Did not even bother asking me. I work for a really good company and they me a copy of I-140 without me asking them. I was also under the assumption that it was filed under EB2 untill I looked my I-140. So, don't assume by looking at your Job desciptiion.
Don't tell me the Job description was also hidden from you, it's straight forward to make out from that description..

Your case is slightly different from PWMB cases who filed last month. On an average all cases will take 3 months to adjudicate. Now even PWMB cases filed last month may take another 2 months. Your case is adjudicated now itself.
We are at the mercy of spillover to make things move, looks like the entire cap of EB2 I/C appears to have been used up based on 6K approvals last month. You maybe lucky to get approved this month itself if numbers are available or allocated or may have to wait till start of Q4 in the worst case scenario in absence of quarterly spillover.

If the attorney asks to file a I134 (Affidavit of Support) from the primary to all derivative applicants then the bank statement is required as an attachment.

one will need bank statement if your income is below poverty line , then you need 3 times balance of what is short of poverty line.
Lets say if you are family of 3 and if poverty line says 15k and ur income is 12k then you need 15-12 = 3k * 3 = 9k in bank balance.
If you make more than what is suggested , you don't need any balance.

That is exactly the point Iam making; some posts that have been deleted were just questioning the deletion policy. When I was the moderator and deleted posts I have always explained back to the group or private messaged. Maybe similar explanation needs to be given in all fairness. Since you may not have read those posts I give you the benefit of doubt.
Additionally there needs to be higher tolerance on deleting posts and banning people. I read some of the postings not all that were deleted and it is disappointing to note that this happened. Some of the posts were mere requests for information about date movements I do not believe that disclosing the information if any will cause any harm to anybody here or help anti's. My point is that if information is posted on IV before other places it increases the reputation of IV itself. I hope my point is well taken it is general not anything specifically for you.

Iam not sure about this my attorney asked me to submit the I134 with details of all bank accounts and investments. The idea seems to be to send these details to all organizations that support public charges. There is a Para there that you are affirming that your dependents will not become a public charge and if any application is submitted then the information in I134 can be used for the evaluation. I just submitted this because my attorney asked for it.

The I134 attachments have far greater information than just bank statements, you are liable to declare any investments property in USA and even in the home country. Best thing would be to ask your attorney for the list of documents and aim to send everything by say the 15th so that they have ample time to work on your case.

In the current environment it will be extremely tough to get the EB2 I140 approved especially for future employment, the company should have a good balance sheet. AFAIK you are legally obligated to join them only after GC approval but most of them will like you to join them sooner.

I got to read my I485 application yesterday night, just sent them back to the attorney today morning. belmontboy's response is perfect and your forms are fine. Primary and secondary is noted on page # 1 of I485. Your forms are perfectly fine.

I did not get anything from my attorney except for the confirmation. However since I have sent personal cheques I can see when they will get encashed, someone mentioned it takes a week. Since 10K applications just I + C will be reaching them it will be slow.

My attorney did not ask for this form nor any bank statements. I specifically asked him if I should provide this, but his explicit answer was NO. My research on the web also revealed that this varies from attorney to attorney. My view is that it is probably a document when a US citizen sponsors somebody to come to the US on (family based) greencard, so they need to make sure the person can be supported. Since, we're already in the US, the need may not be there. That's just my guess.
Hope this helps others.
It definitely is not mandatory, may vary from attorney to attorney. Majority view here is that it is not required.

I have an active I-140, approved back in 2008, from my employer. They had a change of address last year. They moved from address A to address B. Both the address are in the same metropolitan area. The distance between those two addresses is less than 15 miles. There is no change in their business, my title or job duties or description.
Is my I-140 still valid? Can I apply for my AOS without any problems?

I am hoping my priority date (early December 2007) is current in the next visa bulletin. Say it does, I plan to get all medical tests done right away and get my complete application ready to be sent on December 1st (will request EAD + AP). Hopefully I'll get AOS receipt in 10 days. The reason why these dates are important is I am leaving for India for a month long vacation around December 2nd week with my wife who is on H4. We plan to go for H1b/H4 stamping. I am a full time employee with a reputed company so 221g should not be a problem but you never know.
Question : If there is H1b stamping delay, will USCIS send me EAD+AP within 90 days of my receipt without fingerprinting? If yes, I can probably have someone mail me EAD+AP in india and I can use that to re-enter the country. Sooner or later, the dates are going to be pushed back to July 07 timeframe so i can get fingerprinting done later when dates become current for me later in the FY. Appriciate if someone can respond. Thanks

I am posed with a very big dilemma here and was wondering if anyone her could possibly guide me. My Husbands priority date is Mearch 17, 2008 and I was reading in the forums that this may be a good few months for the EB2 as the decmber bulletin may advance to Dec, 08 and eventually the other bulletins may advance this further.
I have been eagerly awaiting my EAD so as to quit my H1 based job and have a relaxed schedule. I have also planned a trip on the Decmber 19th coming back in mid- Feb.
If my date becomes current in Decmber, then i m guessing, i can still send the documents, get the receipt, complete finger printing and then possibly leave by third week of december and safely come back in feb.
if my date becomes current in jan bulletin, then how should i play things out to prioritize my EAD but also plan an India trip around that somewhere.
Please advise as to what the best course of action would be.

Belmontboy, even if it went to Phoenix, it'll eventually reach NSC. I was in NJ and my employer in VA when mine was filed but the application went to California from where it was transferred to TSC. The only issue with this (any applications that get transferred) is, when the time comes to issue the GC there will be slight delay. I have seen this happen to may people and almost to all that had their cases transferred. I was current since May 1st this year, but got the actual card about couple of weeks ago. I don't know the exact reason but may be they don't handle transferred cases with that much care. I have to add though that of the 3 EADs and 1 AP I had applied I always got the approvals within 30 days. So, don't worry and enjoy the semi-freedom.

Yes your date will likely get current in this VB. AFAIK you can travel after you get the receipt notice. EAD / AP normally take 3 months to come by though so probably you should be back by then. You might miss your fingerprinting appointment as these days its normally coming within the month of filing itself. If you have an attorney he /she can coordinate that with your schedule by requesting for another appointment. Iam not sure if EAD / AP also requires biometrics in that case your EAD / AP may also get delayed.

The requirement to file for I485 is that you should be in US at that point of time. The Dec bulletin should be out soon so that will be a very good indicator, if you make it in this time it’s great otherwise if you miss by a small margin there may be a chance in the next bulletin. For your date to be current still significant movement is required it is outside the current news projection as well. The dates will retrogress also after sometime. Best to buy a flexible ticket or from an airline that charges lesser change fee. Fingerprinting may take atleast a month. This is my personal belief that all movement should happen in this bulletin itself so hopefully it will be a good indicator, subsequent bulletins may have lesser or no movement because the dates cannot be sustained at this level for long.

If you have a valid visa you can travel while your AP is pending... this will have no effect on your pending AP. I checked with my attorney and they made it clear that I can travel while my AP is pending. Let us know if you've heard otherwise.

According to the news guidance the expected cutoff was 01-MAR-2008 anything beyond that atleast for the Dec bulletin looks unlikely. Lets wait and watch for the bulletin it should be coming soon.

Heard back from lawyer.
Now all I-485's (identified by regions) with either be sent to Dallas or Phoenix lockbox - as per instruction of USCIS. They process filing fee's, once they are done, the applications will be routed to appropriate service center's.

My lawyer's response....
Your I140 is valid until revoked by the employer or if there is no longer a bona fide job. The fact that your employer moved should not affect the validity of this I140. In order to proceed with I485, your employer must provide a letter stating the job opportunity is still available and this must be submitted with the initial I485 filing. If this letter will not be provided by your employer you cannot file the I485. A support letter is an initial requirement of the I485.

My own projection for the intake was just till 31st Dec 2007; however the news is very exciting and since it comes from the man himself 01-MAR-2008 is likely. The idea would really be to have 30K as the target for the intake out of this year out of this I believe that 6K in terms of cap has been used (Oct Approvals) there is another 6.5 in the system by last month (PWMB + 2.5K demand data) and around 10K will be added this month (Nov) . So realistically another 8K maximum to add this month. However if CO likes to have a larger buffer or if lesser people are actually filing then there can be more movement this year. Similar thing should also happen in 2012 for this it is important that they do not overshoot by a large number otherwise it will be hard to justify another intake. This year’s trend is still in its infancy let’s see how things move.

We got the magic SMS and email @ 9.15AM.
PD Date: 05/07/2007.
I485 Denied: 12/18/2008 (for missing Biometric Information Sheets) both spouse and I.
I-485 Reinstated date: 02/11/2009.
Date became Current: 10/01/2011.
SR opened date: 10/04/2011.
Congressman requested date: 10/07/2011.
Infopass Date: 10/21/2011
I-485 approved date: 11/04/2011.
After 11 years here we become Green. I believe request to Congressman definetly works.
I don't say folks to stay tight. I request you all to be restless like me and do whatever you can, like calling L2 repeatedly, SR request, Congressman, Infopass DO EVERYTHING within your limit afterall it's you GC.

To me it looks like CO didn't look at the I-140 inventory or anything like that to move dates till now. Also, from the recent announcement, it doesn't look like he is going to. All he cares about how many GCs requested based on the approved I-485 (I assumed) to move the dates around. The moment demand exceeds available numbers, dates will retrogress. Till then, if CO continues to advance the date or not is anybody's guess.

Yes she can go for H1B stamping in the current situation. But H1's now a days is a big hassle. Even if she gets her EAD her H1 will still be valid until she uses her EAD.
Ofcourse she can leave the country while her AOS is pending, how do you think EB3 people who filed their AOS in 2007 are travelling to India?
What do you mean by she will invoke EAD? To enter US you will need a valid visa or an Advance Parole(AP). Make sure you apply for AP along with EAD and there is no question of AP without EAD.

We should be cognizant to the fact that 8.5K of the cap has also been burnt out. You have probably omitted the 6K inventoried people between Apr 15th and Jul 15th. The 3K per month approximation is quite good.

Normally EB2 wait time is 5 years, some people may have applied just before the Jul 2007 fiasco they may have been luckier.
Basically what will happen is that once the country cap is removed ROW will retrogress. People before this date likely all before 2009 will get greened the same year. Some of us have spent more than 4.5 years just to file for 485.
After that every one moves in unison so it will take 1 to 1.5 years from this point.
This bill will cut the EB2 and EB3 wait times for retrogressed countries to half.
Currently EB2-I is guaranteed only 2850 GC's every year. With this bill they'd be guaranteed 29,000 for the first year (28.6% of 85% of 85% of 140K). This no. will increase slightly in following three years due to phase-in rules. In addition to this, EB2-I will get EB1 spillover and EB4/5 spillover. Historically EB4/5 spillover has been around 10K and doesn't vary much but EB1 spillover has varied from nil to several thousands last year.
Comparing with last year total allocation of around 32-33K, this can still be 60% jump. Last year's SOFAD resulted in dates moving about 1 year total during a dense period. We are now slowly approaching comparatively sparse period. So, all in all if EB1 spillover doesn't disappoint and the bill passes, EB2-I can end up around Jan-Feb 2009 by Sep 2012 bulletin.
But EB3-I gets straightforward 10 times increase in allocation. So in terms of benefit it's definitely greater for EB3-I but it's significant for EB2-I too.
I'm eagerly waiting for it to be put on house calendar.

Here's how I arrived at this data. Based upon my description you can decide whether or not I omitted anything. I started with combining PERM data from all of the previous years and filtered on India and included "Certified" and "Certified Expired" cases. I then extracted the actual priority date from the A#(which is hidden in Julian day format) and ordered the entire set by priority date. Next, I excluded all the data for which Priority Date as well as Approval Date was before Fiasco, because they were already included in the I-485 inventory. The remaining information was grouped by month based upon priority-date. Then I multiplied by 0.75 (the EB2/EB3 ratio) and then by 2.2 (the family multiplier).
So, this includes ALL of PWMB and when we are considering a total inventory target for this year burnt inventory needn't be substracted as it is these people who are getting these GC's.

Congrats smanohar and rakesh76 . If you don't mind, can you share if you did anything that helped USCIS pick up your application and approve? Things such as calling USCIS helpline, raising a Service Request, meeting senator etc?

Got text alert and email from cris at 1:41 am today with the status updated to approved.
My PD is 25 th July 2007 and the case was filed in Nebraska.

Looks like quarterly spillover or monthly access allocation is in play. This will help to bring actual GC to people faster. I believe all preadjudicated cases from Jul 2007 should get approved this month.

Congrats smanohar and rakesh76 . If you don't mind, can you share if you did anything that helped USCIS pick up your application and approve? Things such as calling USCIS helpline, raising a Service Request, meeting senator etc?

Thanks prem_goel. I didn't do anything. Last EAD/AP was applied in last year October. In fact I decided not to apply for AP last month when dates became current for me and No my last name doesn't start with A,B,C etc . :)
I guess they are using PD as the "protocol" because if you see the other tracking site then you will see applications with PD around 25 th July getting approved in last 4 - 5 days.

As per the October filers tracker, I see majority of them got in 2nd week (mid to end) whoever filed in 1st week of October, so guessing the same trend for November filers too, my application has reached to Dallas Lock Box on Nov 1st early hours(8.50AM), hoping for the receipt no some time next week Wednesday to Saturday (receipts will come in through postal service).
I am not sure about EAD/AP approval without bio metrics, but strongly thinking that you have to get it to be done in order to get EAD and AP.
Will see some updates next week mid hopefully

I did not get anything from my attorney except for the confirmation. However since I have sent personal cheques I can see when they will get encashed, someone mentioned it takes a week. Since 10K applications just I + C will be reaching them it will be slow.

Receipting may take 2 weeks from submission because of the high number of filings ~ 10K. So far no one has reported cheques being encashed or receipting.

Here's how I arrived at this data. Based upon my description you can decide whether or not I omitted anything. I started with combining PERM data from all of the previous years and filtered on India and included "Certified" and "Certified Expired" cases. I then extracted the actual priority date from the A#(which is hidden in Julian day format) and ordered the entire set by priority date. Next, I excluded all the data for which Priority Date as well as Approval Date was before Fiasco, because they were already included in the I-485 inventory. The remaining information was grouped by month based upon priority-date. Then I multiplied by 0.75 (the EB2/EB3 ratio) and then by 2.2 (the family multiplier).
So, this includes ALL of PWMB and when we are considering a total inventory target for this year burnt inventory needn't be substracted as it is these people who are getting these GC's.
The logic looks sound; I believe you are capturing everyone including China as well. The figures for the months before Jul 2007 look a little week. On another note have a look at the Oct Inventory for Jul 2007 you will find that the EB2 I + C count exceeds 3000.

EB2 outlook is currently 5 years so sometime in Jun 2014 your days should be current. However if 3012 passed it could become 1.5 years instead of 3.

whats the outlook for 2012 if the next bulletin does bring about Mar 01? do you see post mar 01 being the new pwmb?
Everything depends on the following 3 factors.
1) What SOFAD is expected if its 30K then CO's prediction will be realized in this VB itself. Move backwards by 1 month for every 3K less.
2) What kind of buffer CO needs, ideally he should work with a small buffer to justify the same kind of thing in the next year as well.
3) Current I140 backlog is 30K as opposed to 15K last year if this is cleared to last years level SOFAD might drop by 8-10K.
The current approval trend is very encouraging but we should be cognizant to the fact that 8.5K SOFAD has been used already. IMHO the chances of this bulletin going to 01-MAR are 50-50, there is definitely some chance for the next one as well if this fails. Let’s see some of the comments and guidance in the VB. It will be a very close race for all Q1 2008 folks. All the very best.

If the bill passes your date should be current immediately and you should be greened within 3 months of filing.

For anyone beyond Q1 2008 it will be very tough this year. Nothing is impossible though but likelihood is less.

I believe for your kind of PD it should really be 4 weeks after biometrics. I believe atleast the primary is approved and awaiting the derivative applicant if its both then also maximum 2 months after biometrics.

I recd txt / email on friday evening.. today showing 'pending' withdrawal for check..
although i submitted separate 1145 for me and my wife, I received all the emails and txt.. it is for dallas lockbox.. hope this helps..

I know this is probably not the best place to post but still i feel many people may have similar experience as my case.
My wife and myself has valid ( valid till 2013 dec) H4 and H1 stamped in our passport and our priority dates are Dec 05,2007 which would be hopefully current in December bulletin.
I asked my company HR that if file for AOS with AP/EAD in early december can we still travel to india in Middle of january eventhough AP may be most probably pending.
They replied saying I can travel with my H1-B but my wife can't . My wife has valid H4 and never used EAD/AP ( she nevere had it :)). Does this make sense? if H1 is valid than H4 should be too? isn't that the case?
Anyone has idea , weather one can travel on H4 while AP is pending?

As long as she has a valid H4 stamping in her passport, it should not be an issue.

AFAIK you and your wife should be good to travel since your visas are stamped as well no hassle of stamping. All you need to ensure that when filing is done you are in USA.

Friends lets be kind to all, sometimes people need answers to simple things. I agree that we should not deviate from the topic too much. Let people post their approvals here because it helps to capture a trend like for example all preadjudicated people are approved.
Options
1. I would rather say don't reply to unrelated questions than saying people to not ask unrelated qustions in this thread.
2. I don't see any harm if people are asking questions in this popular thread and getting their answers. sometime you don't get attention in new thread than this.:) so let be everybody happy whereevr they ask questions.

How long does it is expected to take. EAD & AP should be in hand before the end of Dec.
Expecting dates not to move back July 2007, how long should I expect for a GC ?
Any calculation can guess that ?

PrinceVA, when did you file your AOS, early Oct, mid Oct or late Oct/later? And when did you receive the receipt notice? Any insight is appreciated. Thanks!

They received on Nov 1st, Receipt Date Nov 3rd, I received the notice in mail Nov 8th.

Demand data for Dec 2011 is now available on the State department website. Cumulative demand for EB2I prior to Jan 1st 2008 is 50.

Friends,
Just an update, I had sent my documents on Nov 2nd, and recevied by Dallas Office on Nov 3rd 10:30 AM. I just checked my bank account, and found that USCIS has done an EFT in the last hour. (I had sent Personal Checks)
Waiting on the receipts now :)

Demand data for Dec 2011 is now available on the State department website. Cumulative demand for EB2I prior to Jan 1st 2008 is 50.
The demand data published is certainly excellent news. What it means is that all preadjudicated cases are completely taken care of. The PWMB cases as Shaumack has remarked may in a fair number of cases may never actually make it to the demand data, they will get approved as soon as they are adjudicated. we might start to see PWMB case approvals for the batch Apr 15th - Jul 15th by the end of this month and definitely by early next month. I sincerely hope that the news of 01-MAR-2008 turns out to be true.

The ironic thing on the demand data is that the Demand for India is exactly 2X times China. I don't know if we these numbers are real or just a guesstimate from DOS.

If demand is less than supply, should they not make it current ? Looks like it is ridiculously under subscribed. I think bulls need to take over from here.

All PWMB's who filed last month should see green starting end of Nov to end of Dec at the current rate. Don’t worry about EAD / AP. It all depends on CO continuously releasing numbers.

Inventory is a snapshot from 01-OCT so these cases were not there at that time. Currently these cases are not adjudicated but they could be approved as soon as they are and a fair number will therefore never show up on any demand data.

That demand is only until July 2007. USCIS has started taking in new demand post July '07 only recently since last month. So, those demand numbers will begin showing up in the subsequent visa bulletins.

You will also recieve the receipt notices. And if you are in a major metro area, as compared to your attorney office, you may receive them even earlier. The 485 receipt number is generally on the back of the cheque and if u applied for parole and EAD, they may be the next two following receipt numbers

I filed in oct and my PD is may07 I am worried when to get my EAD/AP and now you saying that they will adjucate the cases in just 2 months and issue green card? that will be a surprise for me man.

Where do we have PWMD cases are they in Demand data or Inventory? They are not in the demand data because they are not preadjudicated yet, not in the inventory because inventory date is before they were filed.

So what data would they be using to move the dates? Why always this bias towards India and China without data and why do we have to always agree and accept the bias.
Either follow the law or show us the metrics that is used to move the dates.
