I filed I-485 in July 2007 - EB-2 with priority date feb 2007. so, i got my AP/EAD. However, i am still on my H1b as i did not change the job and recently got the H1b approval but the visa on my passport is expired.
I had also applied for canada's immigration and have received with with few months left to land there. looking at the current state of EB-2 movement, i do not think GC will come in 2011 .. so i wanted to keep my canadian option on as a backup.
I wanted to do the landing there and come back immediately to US. The question is that is there any rick on the pending I-485 by doing that ?
If i enter Canada, how do i come back to US - should i do the H1b stamping there ? If i do H1b stamping there - will they ask me question as my did i do the landing n Canada ? What if they reject my H1b then can i enter back on AP ? Is using AP instead of stamping a better option ?
