IV friends,
I'm in a situation where i have scheduled my visa stamping renewal (h1-b) for me and my spouse @ US consulate in toronto. now the issue/problem is that my current stamp expires on 14th march, 2011 and my scheduled appointment is 28th march, 2011.
The petition for both of us is good until 31st December, 2012.
Not that i'm anticipating this but in case my visa gets refused for whatever reason, can i re-enter US on an expired visa but a valid petition??

No...you can not. You will have to go India from there. Why do you think people are not going for stamping even to Canda. This is the exact reason, if you are denied you will be in soup.

absolutely 100% agree with you. I have no clue as to why Indian citizens go to canada for h1b stamping. I know of many of my friends who went for a couple of days for stamping and were (and some are still!) stuck in canada (paying hotel bills, losing job vacation etc) for more than a month. Why not go to India instead?atleast, u will have a place to stay if process gets delayed.

I don't know about India but for Pakistanis Canada is a better option for the following reasons:
1) Canada visa stamping is almost like a vacation (especially Vancouver)
2) Access to US embassies in Canada is much more convenient. US Consulate in Islamabad is literally hidden from sight, you're almost blindfolded and transported there.
3) Process is much easier and high chance of getting visa stamped within 2 business days.
Me and my spouse went to Vancouver for stamping in Sept last year. Very pleasant experience.
