Please help on this H1 Issue

My H1-B extension was filed on sept 1st,requesting for additional 3 years (after the 1st 6 yrs) to VSC on regular basis. My labor and I-140 were also approved. My I-94 has expired in September 23rd 2010 and I'm still working on the basis of the pending application.

My query is


1.How many days can any one work on pending H1-B aplication?

2.After 6months of I-94 expiration ,is it illegal to stay with out visa?

Please help me on this ....

You can work upto 240 days of H1 expiry date after filing. You can stay in US until you get the final decision on your H1 file. Worst part if its get rejected, you will be out-of-status immediately( or from date of I-94 expiry date).

Having in mind what previous person said, it was a good idea to expedite with premium processing on reaching 5th month of it's pending status. You would have your decision by now without overlapping 6 months limit. However I haven't seen yet H-1B transfer to take that long, something else should be wrong there. What USCIS website tells you about status of your receipt number?
