Hi there,


I am unable to find status of my Name Check and I-485 application.
If I call TSC - they say ask National Service center; we do not provide status
and If I call National Center - those guy do not have anything beyond what is shown at USCIS website.

My PD is 12/2002; EB2 - India.

Please provide pointers to the issue.

Infopass is the best way to know about it. When you go for it they will give you receipt with stating reason(s) on it.

My name check was first initiated in Sept 2007 and had been pending since then. I called last week and was told that it was still pending. However the IO mentioned that she would re-submit it to the FBI and that I should call back in a week or two for a status update.
I called today and guess what, I was told that my Name check has cleared. Was pleasantly surpsised to know that - although I am aware that it does not matter anymore.

Call up using this sequence and ask if your NC has been cleared:
Call 1-800-375-5283
Press 1
Press 2
Press 2
Press 6
Press 1
Now enter your receipt number
press 1
press 1 (now listen to the case update info)
press 3
press 4
(now if you listen a male voice prompting you to hold the call that means the call is going to IOs desk, if it says no IO is available, it will redirect it to NSC, you can hang up and try the next morning)

I had a Infopass apt this morning and the IO told me that my name check was cleared. My PD is Jul 2005 (EB2 India). anyidea I get approved in August?

I called to check on the status of my name check, its still pending:confused: I am July 2, 2007 filer, just wondering how it could still be pending. I thought they were supposed to clear in 6 months. Can someone help explain?

Did you call 1-800-375-5283?

I just called this #, and followed the instructions delax posted - and ended up at a CSR's desk in NSC. She told me everything is 'clear' on my app. and is just waiting for an IO and visa (She told me abt valid finger prints etc and checked for about a minute or so)- But she also told she dont have access to the Name check info (It is apparently some other system acc. to her) - but repeated that there is no issue with name check anymore due to the 180days rule.

May be you got an "IO" (Some higher level mortal than the "CSR") who had access to name check info.

Yes, I called that number. How do you tell if its a CSR or an IO? She just went with the case number, not alien number.

From what I understand, CSR is the call center employee, who acts as the first level screener - and she fwds the call to an Immigration Officer "IO" if necessary (as determined by them).

Hello,

I am a July 2 filer but got my FP done last week of July 2008.
So, when is NC initiated? When 485 is filed or when FP is done?

I have tried calling TSC and they are not giving any status update on NC. I do have an Infopass appointment on Wed but would atleast like to know when is NC initiated..

I recently have given my FP , but my NC was intiated in Sep 2007. so there is relation for NC& FP

But NC not yet completed ..!

I called some time back to check on the Name Check status and they told me the status as seen on the USCIS web site.

But, when I called today, she told me that my FBI Name Check has been cleared!.

Looks like the first call went to CSR and the second call went to IO.

I guess only IO can tell if name check has been cleared!

Now, the question is what's next? No one really knows on what basis USCIS will be approving GC in August bcoz Name Check need NOT to be cleared...

I check the website every few hours to see if there is any change in the status......I guess there is nothing else than to Keep Waiting.....

InfoPass folks know when NC was initiated and when it got cleared or if it's still pending or not initiated.


Mimimum amount for NC to get cleared can be as low as 1-2 months.

Has anyone been to infopass recently for NAME CHECK....my appointment is on Aug 7th.. what all do i need to take with me besides my I485 receipt notice and I140 approval notice

Also will they give information about the name check even if the case is not out of processing time. My I485 receipt date is July 26, 2007 and they are processing Aug 10th, 2007 cases...so it is within the 30 day processing period..

any ideas here would be great

Thanks for the info. This worked like a charm.
My NC is cleared but she was not ready to give me the date of clearance or the status of my wife's NC. Said she needs to be on the phone for that.

So, are you saying that your GC is approved while namecheck still pending?
Is there any specific thing mentioned in your card stating name check pending or similar wordings?

I have been trying to get someone to give me info. on my name check. everytime i call USCIS-12261-34 sequence, i am told that they do not give out the status info any more. It seems everytime the same woman picks up the phone. Can someone help me please?

I spoke with an IO from Texas Service Center today and mentioned USCIS memo regarding approving I-485 case if FBI name check is pending for more than 180 days (see http://www.uscis.gov/files/article/NameCheckQA_28Feb08.pdf) released by USCIS on 2/28/2008.

She said that on April 2, 2008 FBI and USCIS released joint statement regarding FBI name check backlog clearing efforts (http://www.uscis.gov/files/article/NameCheck_2Apr08.pdf). She said this memo supercedes 2/28/2008 memo & per this memo all namechecks pending for > 180 days will be cleared by February 2009.

She also told me that if namecheck is pending for > 180 days after Feb 2009, then USCIS will go ahead and adjudicate affected I-485 cases (provided visa number is available, PD is current, I-140 is approved, and other criterias are met).

Just get an Infopass appointment. Calling is of no use anymore.
I had mine today and they told me my NC has been pending for the last 11 months :(

I have been trying to get someone to give me info. on my name check. everytime i call USCIS-12261-34 sequence, i am told that they do not give out the status info any more. It seems everytime the same woman picks up the phone. Can someone help me please?

I read both the documents, they don't contradict in anyway. In the second article it does not state that 180 day rule is invalid. All it states is the plan to clear the pending NCs so please don't worry; 180 day rule is still intact, according to my research based on official documents.

Anyway how abjudicators are assigning visa numbers, I don't have a clue; it is their discretion. I hope they approve based on PD and take 180 day rule into consideration.

Today we had Infopass appointment. The Lady is very good. she checked for me and my husband's Name Check and it's already cleared.

Also we have applied for 2nd EAD/AP renewal before 3 days. Now let's see where it take us.

From my own experience and those of my friends, I can certainly say that the "NC pending after 180 + days it was initiated" regulation works pretty well (at least at NSC). In my case by happen chance I came to know from a level two IIO at NCSC that it is still pending as of the evening before the I-485 got approved ! So was the case with a few other friends (albeit they knew it was pending a few days before the approval).

As such if you are about 200 days past your notice date (since NC's are usually initiated in about 2-3 weeks time after ND) I would say just forget about caring to check the NC status; it would not be an impediment.

We showed the USCIS rule saying "USCIS will honor the actual date that an application was receive in our mailroom; this date will be indicated on the reeipt(in the Reeived Date Box) when form I-797, notice of action is mailed"

The officer read that and assigned an SMP ....the number to track the case.

The officer told us they will send an email to us from USCIS regarding this after 40 days and if we don't hear after 40 days than call the USCIS with the SMP tracking number.

About the namecheck My husband's was cleared. Finger prints cleared
but since we applied togather they are waiting for my name check to be cleared.

I also showed her this memorandom rule saying name check is not needed if I-485 is pending for more than 180 days and also asked when is my name check initiated. She said in the mid of october 2007.

She told the FBI has need to clear the older name check waiting for about 3 yrs then 2yrs first then will give priority to other wating for more than 180 day rule.

According to FBI they are planing to give the name check results pending for more than 180 days on feb 2009. So she told me to wait for feb 2009.

If all the other rule like priority date, then processing date satisfied after feb 2009 then my case will be approved.

So I asked her again since my husband finger print and name check is cleared can he except the I-485 approval soon. The IO officer said nope his case needs to wait for my case to get cleared since we applied togather. mmm bad luck for him because of me.

The memo actually says I-485 can be approved if NameCheck is pending for more than 180 days not I-485....NameCheck is always required come what may, they can revoke ones GC if found that you are non-admissable based on the NameCheck response.

Secondly what she said about NameCheck 180 + will be given priority only after Feb 2009 is pure nonsense at best. She got the FBI backlog timeline memo mixed up with the 180+ memo. I was told the same thing a day before approval !! Infopass officers are not one of the best trained.

If they say that...take the badge # /name of whoever said that and the office they are in and lodge a official complaint to the Ombudsman. Would highly recommend doing a congressional inquiry. I am almost 100% sure that unless you have a hit in the IBIS database (a.k.a administrative review) the FBI namecheck 180+ stands tall.

Again, I was told the same thing a day before approval by an non TSC/NSC IIO that it is not applicable for all, you will have to wait and all that.

Depends on who you talk to. In my experience on a comparitive basic NSC/TSC IIO have the latest granular info on your case and are smarter in interpreting memos.

I don't agree. My RD and PD were current for a while. I did not got my I-485 approved. I called USCIS and also took infopass. I was told my case is pending due to name check. I pointed them @ 180 days memo. But was told that the memo is not for all. It veries case to case basis.
