View Full Version : Husband got I-485 approved mine is pending

My husband I-485 got approved saying notice mailed to new permanent resident. But still my is pending still stuck in the Name Check clearence. Me and my husband applied I-485 on one package. my husband is the primay applicant and I am the dependent. Is'nt it wired that one gets approved while the dependent case is stuck in name check. Is it some thing to worry? Will I get a RFE. Will that affect my husband GC too....

Took an info pass and the officer told mine is stuck in name check. My name check is initiated for name check on mid of October 2007 . I can wait for GC. All I am worried is that because of me my husband's GC should not be denied.:mad:

You said husband's is approved- it cannot be denied. Wait for a while and you will see your approval too if there is nothing really adverse, NC beyond 180 days is no more a issue

Hi intheyan,

Your name check has nothing to do with your husband's name chack. It is good that USCIS gave GC to your husband.

Your husband's name check might have got cleared quickly. USCIS new rule is that if name check is pending over 180 days, they will proceed with giving GC. So you should wait and see.

Don't expect RFE because of name check. It only takes time - and now-a-days up to 180 days.

I am in the same boat as you, our's might be approved by end of Sept.

My GC was approved last year... Its been almost a year and my wifes application is still pending! 2003 PD... She has been current for months now and nothing has happened... We took and infopass and the officer said its stuck in name check, but now with the 180 days rule he said it should get approved anytime and that we should have patience... This was 3 months back! Still nothing... :mad:

I had called USCIS and my NC is cleared but the problem is the processing time, they are still in July 16th 2007 and our RD is Aug. 6th 2007. I am hoping that they catch up and move dates same as NSC.

We are also in the same boat. Mine (primary) got approved and welcome mail sent, however my spouse's status is not changed, not even a LUD.

I have called USCIS and talked to the nice lady and she escalated this case to the supervisor.

Goodluck. Your husband's GC is safe. You will also get it in time. Don't worry.

Take infopass, etc. every couple of months or so. Not to scare you, but one of my closest friend's GC was approved 3 years ago. His wife's is still pending in name check. But now with the 180 day rule you should be ok. I am not sure though if USCIS is following the 180 day rule.

But dont worry, you will get it. Celebrate your husband's GC for now!!

Sue USCIS and you will get GC within 2-3 months of filing a case.

Same situation here. I was approved on 9/5/2007, almost one year ago and my husband nothing.

I [primary] got my GC approved on 08/08/08. Got the card on 08/15/08. My wife's [dependent] status is still Case Received and Pending. How do I find out if its in name check or something else ?

Waiting for wife's I-485 approval. No LUDs on wife's I-485.

My case is reverse. My wife and son's GC got approval on 15th aug last week but mine is still pending. I called USCIS to get info on my case, IO asked me to take INFOPASS appointment. It seems INFOPASS guys will have more information than USCIS customer reps.

I am planning to take INFOPASS appointment once I get physical cards of my family.

Similar case here. I received my card in Dec 2007 and my wifes application is still pending (TSC). We took an InfoPass appt a couple of weeks ago and were told that her case status is "PreAdjudicated, under review". The IO also advised us "not to bother TSC too much, else her case might be pushed back"!! So, its just a wait and see.....

Looks like quite some people struck in this situation. When I called TSC, the response I got was, case is not within the processing times. In that case, howcome they processed my case and most of the people getting all together.

As for as everything going good, there will be no problem. If there is any struckup, it is very difficult to work with CIS.

I am not sure how much Infopass going to help.

Any ideas on what that means?

My husband had sent in his EAD renewal end of July. We have not done anything since. He got his GC on the 15th of August. :-) Hope my approval comes on my birthday in 2 weeks :-)

One of my friend is having the same issue ... His GC got approved like 6 months back ... His Wife's GC is still pending ... Service center is TSC and his priority date is current ...

I got my GC approvel almost a month back but did not see any LUD or approvel on my wife 485.
Man that sucks after seeing october visa bull for EB2 going back to 2003.

I have the same case. Mine is approved on 8/16/08 but am still waiting on my wife's and Son's. I called TSC and they said that my wife Name check is cleared and my wife and Son's file are not together, I do not know what this mean but will wait.

When i talked to an IO and at infopass too, its confirmed that
they process the primary application first, and then only look into the dependents cases.

if dependents cases are straight forward and ready to be adjudicated, then the entire family will get approved around same time. in case if more processing is required for dependents cases, they get separated and get approved later.

nothing to panic. its pretty normal if we have to believe what IO says...

Current Status: Withdrawal Acknowledgment Notice Sent. I changed my job after 8 months of filing my 485. No body sent any withdraw application on my behalf or myself. Please advise, what i should do now...

What does that meant "withdrawal acknowledgment notice"? Did you request for i-485 originals to be sent to you?

Hello,

I got my GC in 2007 and my wife's is still in pending status. when we went to USCIS and asked what is the reason for the delay they mentioned her documents went for name verification to texas and its all cleared. It's almost 2yrs now and still she hasn't got any notofication.
Is it delaying b'coz of the visa dates? No idea what to do
