View Full Version : I-140 RFE for coworker and its impact on me?

Hi,

My coworker's I-140 application received an RFE today. There are about 6 items on the RFE. About two are regarding his education and work experience. There are about 2 items asking for W2's of the company, ability to pay all employees that have I-140 approved previously. I don't remember the other items.

My Labor and I-140 have been approved and I am a July 2007 I-485 filer. I would like to know if my application is in any danger.

I would like to hear your all's opinion.

if your company is unable to prove the A2P for all previously approved 140s, there is a potential USCIS could revoke yours. Reality, we will never know - Hope for a happy path.

At the time of my I-140 application my company was able to prove ability to pay for me barely. Now with my coworker's I-140 application I do not know the company's situation. Mine was the first I-140 and his is the second in the whole company. Our's is a 50 employee company.

1. In the event they cannot prove A2P for him, would it still cause problems for me?

Also, what if I had left the company and worked for another company on EAD. If the original employer cannot prove E2P for their newer employees, would that still hurt me?

This is kind of unsettling!

If 140 is already approved, there is very less chance that it will get revoked due to A2P. But you never know. If your employer becomes a GC factory, or doing fraud, they may revoke previously approved 140s. If you used AC21, you will be in better shape than now.
