View Full Version : Does Interim EAD exist?

My EAD is expiring on Apr 28. I have applied for a renewal on Jan 5 (more than 90 days ago) and have not got my EAD yet. I called the USCIS no. and the rep suggested I set up an infopass appointment. She also suggested I maybe eligible for an interim EAD. I setup an infopass appointment for next Tuesday.

My lawyer suggests that I not go for the appointment as it may cause confusion in the application. She said she has initiated a follow up inquiry, and I will receive the new EAD before the current one expires. Also, she says the interim EAD does not exist anymore.

Is there such a thing as an interim EAD, and can it be got at the infopass appointment? Does anyone have recent experience in getting an interim EAD?

On a related note, my AP expires on June 28, and I need to travel out of the country for work from Apr 20 to May 1st. The lawyer says I will be allowed back into the US even if my EAD has expired as long as my AP is valid and that it is safe to travel. What are your thoughts on this?

Any help is truly appreciated.

Ah now, a different kind of bird. Interim EAD LOL. When I read the title what crossed my mind was, 'is this for people waiting for PD to be current, and approved i-140?' -- haha! I wish!

With all due respect...IV is increasingly looking like a forum for trolls with single point agendas. Nothing useful or even usable seems to come out of these forums.

Your post contains a contradiction -- that you are being asked to try for something that's already been discontinued. This is the best I can say that might help...

AP and EAD are unrelated...if you have a valid AP you can travel

Thanks. My worry was that if my EAD is expired when I get back, and I don't have the renewd one.. the officer might ask why I need to come back when I can't work. Maybe, I'm thinking from a H1b mindset.

This is hypothetical. I doubt they would ask that as EAD is unrelated to AP.
So expired EAD cannot be a reason for denial of entry.
You don't need EAD to get AP and vice versa. They are 2 separate unrelated documents for 2 different purposes
