One of my friend got his GC last week. He had a Labor (oct 00) and apporved 140 from Company A. He filed a new Labor(11/03) and 140 then 485 with Company B. He did not provide any copies of company A Labor or I140 or mentioned anything to port the date. He got his EB3 485 approved last week.

Any one in similar situation?
He had a Blank on his 485 priority date column.

I am in the similar situation. But still waiting for 485 approval. My both PDs are not current now.

It all depends on his A number , However if his company A 140 is approved before filing 485 , it should not have a A number . If his company A 140 is apporved after filing 485 and he gets the A number from his 485 , then his priority date is automaticaly ported . This is the case with me but your friends case seems to be out of ordinary , or his lawyer requested for porting .

He or His attorney did not do anything as they did not have copies of company A Labor or I140 approval notice. He did not even know his Old PD.

One more case. He got his approval yesterday. He filed his 485 with Sep 03 PD. He got 2000 PD automatic.

Count me in. To my surprise my EB3 (PD 2003) 485 got approved today. I had 2 applications, (1) EB3 March 2003/I40 Approved/485 pending (current employer (2) EB2 Feb 2006 / I140 Approved / 485 Pending (Future employment). While EB2 I140 got approved mid 2007, My EB3 I-140 just got approved 3 days back and to my surprise I saw " Notice mailed welcoming the new permanent resident" this AM.

I am working with my attorney to send out email for Priority Data cary over, but I am sure that mail has not gone out. and this came in as a surprise. I had two different A #s on my 485 and spouses A # was same in both . I am sure USCIS did see this and updated automaticaly without us prompting.



One more case. He got his approval yesterday. He filed his 485 with Sep 03 PD. He got 2000 PD automatic.

I had filed I140 & I485 using EB1 in 2004 but subsiquently got denied.
I refiled I485 in July-2007 for another I140 approval using EB3.

I do see my Old A# number on my New 485.
Do you think I will get advantage of old A# number?
Any one else have same story OR got advantage due to old A#?

It all depends on his A number , However if his company A 140 is approved before filing 485 , it should not have a A number . my case is a bit strange. I have 2 approved 140s from same employer in EB2 category. My I-485 was obviously filed with the older PD 140. However, an ombudsman inquiry has revealed my PD on 485 to be the newer PD. My lawyer is following up to get it corrected.
I belive the reason could be that the 140 with more recent PD was approved first as it was PERM. The 2nd 140 was filed when labour approval from backlog center came in. so, looks like the PD of the first 140 is getting automatically stuck in the USCIS system for given A#. If you want to do something different, you need to follow up.

Strange creatures. They enforce dependency between two discrete sets of data. Maybe this is the new database "merge" magic to happen very soon. :rolleyes:
