Hi friends,

We know that EB2 is getting stuck in EB3 because of PD porting. I request you EB2's not to procrastinate and send the letter in the next post to the USCIS director. You may mail it with or without your contact info and stop this illegal practice.

Pls do not be lazy to mail this letter. It will save atleast 5 years of tension in your life. If you think others will mail for you are sadly mistaken. There were only 3 letters till today. We need 100 letters atleast to be mailed to the director.

Sir,

We would like to inform you about the injustice being done to Employment Based Second Category (EB2) applicants of India and China.

An Employment Based Third Category (EB3) applicant of India and China who has an approved I-140 petition is being able to port (recapture) his earlier EB3 priority date to EB2 category. E.g. An EB3 applicant with an approved I-140 petition and priority date of June 2002 would retain this early priority date even if he gets a new EB2 I-140 petition with a priority date of June 2008. This increases the wait time of EB2 applicants of India and China considerably.

This procedure followed by USCIS is in violation of immigration law sections pertaining to priority date of individual applicants.

(a) Preference applicant. The priority date of a preference visa applicant under INA 203 (a) or (b) shall be the filing date of the approved petition that accorded preference status.
(b) Former Western Hemisphere applicant with priority date prior to January 1, 1977. Notwithstanding the provisions of paragraph (a) of this section, an alien who, prior to January 1, 1977, was subject to the numerical limitation specified in section 21(e) of the Act of October 3, 1965, and who was registered as a Western Hemisphere immigrant with a priority date prior to January 1, 1977, shall retain that priority date as a preference immigrant upon approval of a petition according status under INA 203 (a) or (b) .
(c) Derivative priority date for spouse or child of principal alien . A spouse or child of a principal alien acquired prior to the principal alien's admission shall be entitled to the priority date of the principal alien, whether or not named in the immigrant visa application of the principal alien. A child born of a marriage which existed at the time of a principal alien's admission to the United States is considered to have been acquired prior to the principal alien's admission

We request you to investigate this violation of immigration law and remove porting (recapturing) of priority date from EB3 to EB2 categories. This would reduce the waiting periods of EB2 applicants of India and China considerably.

I am not sure what is illegal in porting if porting is allowed? Please continue to support IV goals and do not create divisive campaigns that benefits certain groups. Please work with your state chapters who can guide you on channelizing energy on fixing the broken immigration system. Thanks and appreciate your understanding.

Think something new. May be you can think about the following to request USCIS

1. Send everyone home except YOU
2. Send everyone home except EB2
3. Life imprisonments to all EB3

Sit and think after midnight, you will get some bright ideas.

We need people like you every few weeks to ease out the pressure. "Lighten up" thread is not enough. Keep going.

Poor USCIS or at least the officer who reads your letter.

I worked for one of the worlds largest Telecom companies for more than 5 years and got i-140 approved under EB3. I was already qualified to get an application filed under EB2 based on my prior REAL work experience but as a policy , the company did not do any EB2's.

At my next job at a wireless startup, my i-140 has been approved under EB2 though i am still struggling to get my priority date adjusted. Both these jobs were with real companies ( NOT BODYSHOPS ) . Can you tell me why I should not be able to port my priority date.

I got greencard recently under EB-2. I don't understand why people like you think EB-2 applicants are elite, and want to stop EB-3 to EB-2 porting. Its perfectly legal and acceptable. So, when you are driving on a freeway and the lane you are in moving too slow, wouldn't you try to move to another lane? The same analogy applies here.

Narrow minded people like you kill little enthusiasm that is left on this forum. I am sure people like you want to close all immigration pathways once you have your own greencard/citizenship. Wait a minute, no you won't do that until your spouse/brother/sister and all your extended family gets in here, and then you start campaign to halt all immigration. Pathetic.
