EB2 Perm Processing

Hi All,

My company is initiating GC process for me. I will be happy if the following questions can be answered.

1. All are Eb2 categories under PERM processing? If not, what should I ask my attorney for to make it PERM.

2. Currently I have 7+ years of experience in IT. I have a masters. But my job expects minimum 3 years of experience and a Bachelors degree.
So in this case am I eligible to apply in EB2 perm processing.

Please help me with these questions.

Eb2 needs MS or BS + 5 years of exp. so urs will be eb3. all Eb2 or Eb3 labor process are PERM.

For EB2 job should require Masters or BS +5 years of progressive experience, note that experience should be progressive.

Can a Programmer Analyst --> Senior Software Engineer in the same company be considered as progressive experience to be qualified under EB2 with a Master Degree or Bachelors + 5 requirement in the Advertisement??

To qualify for EB2 you need either Masters or Bachelor +5 years of progressive experience.
Experience should be aquired from another company ie you can not use your experience aquired in the same company who is applying for your EB2 petition
even if you worked as a contractor..

you have 7 years of experience..i am assuming some years of work are with a different firm...
so make sure you meet the MS + yrs of exp meet the EB2 criteria...

Job requirements decides EB2 or EB3 and not your experience. If company is ready to change job requirements to BS +5 yrs, only they can file your I140 as EB2...

I was just told by my lawyer that EB2 needs BS not a master's degree.
My job requires a master's. Mine was filed for EB2 but the lawyer says the case will be audited because the job requirement is not normal, that is should be requiring a BS.
