Yes, I just spoke with an attorney about this yesterday. You need the appropriate research submitted backing this up and most are approved with it.

My 140 was denied by Texas Service centre earlier in April this year. I have 3+2 yrs. education from India. My attorney filed an appeal in May with the detailed appropriate research which was from a very noted firm. According to my attorney when we file an appeal, the center that initially denied the case has the opportunity to look at the new evidence and approve it if satisfied. I was hopeful that with the new evaluation it would go thru but to my disappointment it did not. Texas center did not approve it and sent it further to the Administrative Appeals Office(AAO) for review in Sept. I am not sure how long it will take here but it seems the wait is definitely more than an year. I am trying to be positive that the ultimate result will be favorable but from what i have heard and read it seems like a doomed case.

When our firm does a 3+2 evaluation we also have a professor write an expert opinion letter and we cite an unpublished AAO decision to support it. We also supply the attorney with a copy of the AAO decision to use in the Motion and file. When this is done the approval rate is excellent.

I will recomend also contact Unitednation/ he is a guy who had helped in past in RFE issues
i did not got his help but i just talk to him yesterday and he seems to be knowledgeable
also he told me one different option in case my rfe denied instead of apeal or MTR file a new I140 with in 30 days and that way you will get their answer quick and you can submit old and new evidance also

Well dear first of all you need to check what your LC states for your job profile an how your lawyer filed your case when the I140 was submitted. If your LC states that a bachelor degree or work experience can be subsituted, you have a chance. You should consult with a lawyer and file for a new I140 application right away to maintain your priority date. A good evaluation is necessary when you are fighting the case on the basis of education. If your LC states otherwise then you can fight on experience also. In case of Indians, unless you have Bach in Engineering, we can't equate bachelors of commerce to the bachelors in business administration in USA. Texas, NSC an other's have gotten smart recently and are trying to deny all cases by finding one glitch on any application. Consult a smart attorney to file a new I140. AAO is going to get you nothing but bad luck. It is taking 18-24 months for them to process such decisions and their office is jut like any other Govt office in India.
