Hi All. I am from China and this is my 6th year in the US. I just graduated and working as a contractor. I would like to have my status in Non-resident because NR doesnt have to pay Self employment tax which is like 15% extra of tax. I am currently in OPT and will go back to china next year. How can I proof to IRS that I am going back to China and have no intention to stay in the US? Also, which form should i fill ? 8840 or 8843. I really appreciate for any suggestion.

hello friend,
You could provide copies of your air tickets if you've already purchased them. If you do have a job offer in China, you could provide the job offer letter indicating your intent to permanently work in China and not stay in the US. Any other form of evidence that can satisfy the government officials of your intent to not staying here in the US.
I'm not very sure about the forms that you mentioned since I've never used them myself. I hope this is of some help.

I don't have a job offer or I didn't buy a flight ticket yet. I wonder if I can send them a copy of my OPT card, letter with address of my mum and dad and myself, and a proof of my bank account in HK. Any more suggestion?
