Folks,
My GC app is currently filed in EB3 with a Sept 2005 PD. Wife's is EB2 with a Nov 2006 PD. Each of us is based on our own I-140s. Since there is no hope for ever getting a GC via EB3 as a Primary, I'd like to change my classification from EB3 Primary to EB2 Dependent.
Has anyone done it and if so what's the process? We both have different lawyers since the applications were filed by our own firms. We spoke to her lawyers and they appear to want all the documentation to file a new 485 (including Medicals, etc)
I had heard that it should be a simple enough case of just sending copies of our respective I-485 receipts and a copy of our marriage certificate (to prove that we are married) If someone has done this (either yourself or via a lawyer), could you please share your experiences. Would like to put this chapter to rest now that the wife's dates are finally current.
