Hi,
I have a question regarding my wife's I 94.
It will expire on Jan 21, 2009. We applied renewal of AP for her 45 days back and not yet at received.
She has valid H4 visa stamping for 2 more years... but started working on EAD (140 is from my employer and 485 was filed for her as a dependent... she got EAD/AP last year and started working).
Now the question is after Jan 21, 2009 is her stay in US illegal? Do we need to go out of US once and come back with fresh I-94?
If it is not illegal how long she can stay in US with an expired I-94?
If it is illegal and we have to go out and come back, do we need AP for sure as she started using EAD or H4 visa stamping is enough for rentry? If H4 visa is used for reentry will her EAD becomes invalid?
Please advice what do you think is the best to do?
