Laid-off, I-140 RFE & Notice Returned as Undeliverable!

Dear IV Friends,

I've been laid-off. Ex-employer responded to the I-140 RFE. I belong to I-140 and I-485 concurrent August 2007 filer.

However, please can you let me know what this "Notice Returned as Undeliverable" stands for ? Is it an approval or denial or another RFE notice ?

I've been deeply depressed and shocked, as I've no idea what would be the implication due to the fact that I've just one year left on my H1-B.

Current Status : Response to request for evidence received, and case processing has resumed.

Start looking for new job ASAP.

Don't do anything stupid. There is always a way out of every mess the life throws at you. I have been in bigger mess than you, and I can out successfully, scarred and brutalized of course, but I survived to fight another day. Trust me on this..

It simply means, you have changed your address and not notified CIS about it. So CIS sent a letter to your old address, and post office sent it back saying that you don't live at that address any more.

Solution: File AR-11 form immediately. Simple, isn't it?

Thank you for your time. I'm not allowed to talk to the lawyer. But my ex-employer HR is helping on this case. I do have an EAD, but unless I-140 is approved, it doesn't help my friend.

I don't know anything about the notice. I hope and wish it's an approval notice..

Thank you for your time and advice. As you may be aware that my ex-employer responded to an RFE already and that the case has been resumed.

But unfortunately, I've received the below CRIS notice. I'm wondering if it's a another I-140 RFE or denial or approval notice.

I've asked the ex-employer about this and I've been told that they have communicated this onto their attorney. I've no clue on this yet.

On December 10, 2008, the post office returned the notice we last sent you on this case I140 IMMIGRANT PETITION FOR ALIEN WORKER as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

It simply means, you have changed your address and not notified CIS about it. So CIS sent a letter to your old address, and post office sent it back saying that you don't live at that address any more.

This is definitely RFE.
Possibly second one, as you are telling they already responded.

Because at 140 stage only communication u get is RFE notice.
If it is approval, they clearly mention it on case status online.

You really have to get back to your attorney, explain to your HR about criticality and act fast.

It may be very simple RFE after all.
If that is done, with 140 approval abd EAD, nothing can touch you.

Again, what do you mean by this? “…. at 140 stage only communication u get is RFE notice.”

The status would show “Notice Returned as Undeliverable” even when the approval notice sent was returned due to some other reason.

Don’t get me wrong, please don’t add fuel to the fire.

Think twice before you post.

Talk to your ex-employer’s HR and make sure the attorney did not return any communication from USCIS.

What was your 140 RFE about? Do you know what response did your ex-employer provided to USCIS?

Agreed, but they do not say this:

And more over, if it is approval case, they clearly indicate the same on the message.

Anyway he already got the message.

See it says approval notice sent. That is what i mean. If it is approval, they indicate in the message.
