View Full Version : I140 Denied I290B filed then got 2 Emails

my lawyer filed I290B for my I140 denial. i got the email from CRIS on December 15, 2008 5:45 PM as

Current Status: Notice Returned as Undeliverable.

On December 15, 2008, the post office returned the notice we last sent you on this case I290B NOTICE OF APPEAL TO THE COMMISSIONER as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

And next Day I got another email for my I290B from CRIS on December 16, 2008 6:30 AM as

Current Status: Document mailed to applicant.

On December 15, 2008 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.


my question is for anybody did it happened like that and also what could be that document? still now my lawyer didn't get that document.

Did you receive the document from USCIS? What is the status of I-290B application? Please update.

That document is the receipt for my I290B. My I290B status is "The I290B NOTICE OF APPEAL TO THE COMMISSIONER was transferred and is now pending standard processing at a USCIS office."

What is the status of I-485 during the I-140 appeal process ?

I-290B applications will be in Administrative Appeal office. It takes its own sweet time to give decisions. You are not alone in this joourney. Please reply with your details. Priority date, EB category, I-140 Query details, etc ..

Hi Guys,
I had my 140 appeal filed, Initally the status was showing that it is in the Administrative Appeal office. After approx 2 years now the current status shown is "This case is now pending at the office to which it was transferred and is now pending standard processing at a USCIS office."

I am not able to get an answer on what happened to the appeal. How does the appeal process work? does it go back to the standard processing zone or does it had to come back by saying the decision made.

So can someone help me know the process which would help me in understanding my status

To the Best I know, Appeal process work as mentioned. Once AAO office take decision (Approved/ Dismissal) on the case, they send back to service center. The service center will do the rest of the process based on the response received from AAO. One way it is Good that you have a update from AAO. Do you know what was mentioned in the decision document ? Also can you please let us know why your case was denied/ moved to AAO?

My priority date is may2007, EB2, I 140 Direct denial because of 3year degree
Both I 140 and I 485 will be denial untill appeal(I290B) is approved

I am also having 3 year degree and my case is in AAO. As per latest information which I came across, EB2 I-140 case is handled with 20 months delay in AAO. As of today, this is the delay, it can increase or the agent might pick yours and validate earlier itself.

I have a 4 yr degree and my priority date is June 2006.
I received my EAD in August 2007
I received RFE on I-140 in October 2007
and I-140 denial in Jan 2008, due to that I-485 is in denied state too until I-290B approves.
My EAD renewal was denied in 2008 becuase my I-140 is still denied..
I haven't received any updates on I290B yet...
I have applied for a new PERM simulateneously
