Guys,
I am hearing that it takes another 10 years to reach my priority date August 2004. Is it worth to try for EB2 now ? I am not seeing lot of analysis work or prediction of EB3 nowadays.. What do you guys think ?

Yes, do it. I am hoping that dates don't retrogress back to my birth year 1975. That's an end game for me.

Nobody knows what will happen in 10 years. there might not even be a GC. looking at the economy, they might even stop all immigration.....:eek:did I wake you up now ?

Dear All,
The tension and frustration of thousands of EB3 friends is understandable. However, unless concrete steps in a united way are taken up, nothing will happen.
Here is what I would like to sincerely state:
1. CIR will not happen - the political situation is very volatile now
2. Visa recapture - the undocumented folks will never allow us to get any piece meal legislation done for the legal immigrants and they have muscle and money power.

There are several thousand genuine EB3 legal workers who are eligible to port to EB2. It is unfortunate that people are very scared to port and land into problems. I think if we take up the issue with the law makers and INS we can find a way out
Several hundred EB2 friends have been benefitted recently and I am happy for them.
If all the affected individuals can make a concerted and united petition (may be send a letter once a week) it will help to ease the situation on the porting front.
We can approach the INS / Law makers with the following proposal :
1. For all EB3 people who have completed a minimum of 5 years on the same job porting should not be made difficult
2. If people have qualified themselves further after filing of EB3 then this merit should be taken cognizance of, and EB2 upgradation should be favourably considered
3. Work out a formula to consider Visa no. allocation on par with EB2 candidates for all EB3 candidates who are waiting in the line for more than 6 years.
Nothing happens unless people rise unitedly. There is no magic. Ultimately each person has fight and win his own battle. But we should always keep trying and think how the EB3 case can be projected and justice obtained.
If all EB3 folks can unite and take up the issue with the INS through IV and also sent 1000s of signed letters (not emails) to the law makers it could make a difference. In the current turbulent situation, I personally see porting as the only workable solution
Please give me your thoughts. I would be pleased support this initiative in any way I can

Porting is not really a nightmare as it is made out to be. If you are genuine and have the right qualifications you WILL get it. Do not be left behind in the line
I have seen some of my friends "breeze" though porting to EB2. That is the ONLY way out! CIR and Visa recapture are a far cry in this political environment

GC In 10 years under EB3, Really !!! You must be Kidding !!! Consider yourself very lucky if you get greened in 10 yrs.. It is much more than that :( Well jokes apart, the wait is pathetic and long one. If your job qualifies for EB2 and your employer willing to sponsor and if all goes well, it is less than a year for you to see the GC in EB2 Category as the PD you have is already current in other category. If you have options to upgrade and if it is not violating the laws, what are you waiting for. For E3 folks, upgrade is a only quick solution, but it is easy said than done. It is not that easy in large companies though :(

Here are some questions and suggestions:
1. Do you hold an EAD? Have you crossed the 180 day limit?
2. Please speak to a law firm and also to your new employer (or the new employer's law firm)
3. If you hold an EAD and if they want they can file an AC21 even before you quit your current firm. Then you would be safe. Please speak to a lawyer
4. Please ensure that the appointment letter of your new firm describes the job exactly as per your labour

The simple fact is, people who have got their EAD are elated and does not want to do anything to fix the back log. People who already have got the GC, do not want others to get the relief.
If there are thousands of EB3 people are suffering...where are they...? Why are they not taking part in the advocacy....
Just posting the wish list on the forum is not going to fix the problem.
We do have lot of people to preach and give the wish list. Do you like to lead this campaign....and get the fix done?

You should not have any issues if the I-140 is revoked...

If option is available to upgrade don't think twice However Porting is not easy if you are working for a large company.

It is estimated that about 60K people are in EB3. Where are they? I have seen only 5 or 10 in this forum. Are this numbers a joke?

Well, what is AC21? It is just an intimation to the INS that you are changing your job but doing the same duties as approved in your labour petition.
There is no standard template or form provided by the INS for this purpose.
The law firms provide information as necessary to the INS. If the AC21 is filed with the INS, then I do not think that the I-140 can be revoked by your earlier employer. I think AC21 can be filed when the new firm offers you a letter of employment. You may kindly check this with a good law firm
Here is an example:
Let us say that you got a job offer with the new firm on Aug 1, 2011. Check with the new firm if they can file the AC21 (stating that you would be joining them on Aug 15, 2011 and that you will be performing the duties as described in your appoved labour). In that case you will be pre-empting any action by your old firm. You can resign the moment AC21 is filed with the INS. This would require a good coordination with the new firm and their attorneys or you can hire an attorney to do that. Once again, I request you to get in touch with a good law firm on this.

Personally I think that the EB3 group have become very tired of the wait and have resigned themselves to their fate. Some of them have got the feeling that they do not receive any support. Being normal human beings, it is but natural that some of the EB3 members vent out their anguish and frustration.
Further, on many occasions any discussions on the porting issue have turned very unpleasant resulting in unwanted arguments and verbal fights between EB2 and EB3 members. This is indeed unfortunate.
Well, from my side I was just trying to sincerely suggest that it would be a good idea to jointly represent the EB3 case to the law makers / INS. I can help in drafting petitions and also writing to all concerned lawmakers and meet my local Congressman, Senator et al. I can also contribute a reasaonable and collect some money if we wish to organize a special event to highlight the problems of EB3 friends
It is the collective will of the people and their urge to win that would bring in success. THe situation is indeed pathetic, but I would wish that EB3 friends do not lose hope totally. What is required is mass representation and unity. That is what I was trying to say. Hope this clarifies

I think as a group we should genuinely empathize with the sufferings of our group members and do whatever we can to alleviate.In fact people who have got their GCs must actively come forward to help others, esp those who are suffering
I full agree with you that most of the people are not willing to contribute or participate actively. From my side I was able to collect $ 450.00 during the last DC meet. If IV organizes anything like that I will happily particpate and contibute my mite.

Tried of waiting...thats the problem. People are just waiting and hoping for others to pick up the tab. I dont think people from other category would come forward to give up their position and support the EB3 to get their GC. Its the human nature...no one would want to give their EB2 position to EB3, and wait for another 5-10 years....More over we are just moving the bottle neck...the real fix would be to remove the country cap and the recapture.
Again, its not about losing hope...they want others to work for them and pay for them.
There are lot of immigrants has joined the Number USA once they get their GC...reason they want to close the gate behind me category... I have spoken to EB3 people personally to join and fix the backlog...they are not interested to do anything and very happy with their EAD.

We never know what idea is going to work out for us and looks like porting is the current proven solution but many people afraid of their angry employers & withdrawing I-140 etc., It would really help if people who had experience in these type of porthing share their experience in this forum.

I think most of EB3 are happy with EAD and just waiting for miracle to happen. all EB3 members need to come together and actively participate in brainstorming/ action items.
Personally, I am tired of this eternal wait and ready to participate in any action item IV come up for EB3

I second this...please join the donor forum as the first step...there are lot of things going on behind the doors which I can not explain in the open forum...if this thing are going to work, it will give lot of relief for the EB3 folks...again I am not allowed to post any information in the open forum....

As you are already aware, you can port and get the GC immediately....but is it going to solve the problem for every one...no. Simply you are just moving the bottle neck. When you consider porting, also consider to join in the advocay efforts, if you want to fix the problem for everyone.

It is true. Porting to EB2 will be always better option. EB2 will be always better than EB3 for individuals. EB3 dates also will move but slowly and waiting time may be 10 to 11 years(now 9 years) unless some changes happens

I have recently visited the Congressman's office and this the feedback I got:
"Under the current circumstances, immigration is the least of the worries for the government". I think there is no need for me explain further on this.
The immediate measure to give relief to several hundred EB3 people would be to make the porting process transparent and smooth. It is true that the bottle neck will remain, but atleast genuine and experienced people who are waiting since 2003 or so will get benefited. I think it is fair
To help well qualified EB3 folks who have put in several years of experience it would be a good idea to work on some admin fixes such as :
1. Eliminating the fear element related to I-140 withdrawal by the employers. In other words, if someone with EAD gets a job and if he files an AC21, he should be free to work at will. The employer should not be permitted to withdraw I-140. (In fact I really do not know if the employer can do it)
2. We should request the INS to issue the ground rules for job transfers for EAD holders. This will eliminate the unwanted stress and tension and harassment by employers.
3. Once people are "liberated" from this bonded labour, they can file for porting boldly.
Atleast we can start a mass mail campaign (letters please, no emails) to all the local congressmen and senators to ensure that INS lays the ground rules and makes it official that EAD holders in EB categories can switch jobs and port after 6 months of receiving the EAD.
It will be a good idea to write letters and then make follow up visits.
I learnt from the Murthy website that there is no written circular or format for AC21. This is the main problem. If the INS clears the road and lays the rules, qualified EB3 friends in the eternal line can come out of this mess.

However, if they have grown up kids, they should realize that without a GC even if they stayed in a state for 10 years, they will NOT be eligible for local fees in Public universities. The children will be enrolled as 'International Students" and non GC folks will have to pay about USD 45000 - 50000 per annum as tuition fees. Is it OK? Can we all afford it?
In fact even to participate in some high shool level competitions (and scholarships too)conducted by certain leading corporates, the children have to be GC holders. To get scholarships in UG courses, you still have to be a GC holder. Scholarships are first given to citizens and GC holders. This is just for your information.

I have Started my porting effort today. I work for one of the Top 10 FORTUNE 500 Compnies. Joined 18 months ago on AC21. Spoke to the HR today and the response seems to be positive.
PORTING IS THE ONLY OPTION FOR EB3. Neither IV nor any one can help EB3 I other than porting. Start before it is too late.

I really do not know your skill set, but the marlet is generally good.
There are a number of mid size companies who can sponsor EB2. Recenty a friend of mine joined one of the top 3 US Consulting firms as a Manager. He has about 8 years of experience. I am given to understand that the employer has agreed to sponor his case as EB2 and that they would help him with porting.
You could check the regular job sites and I wish you all success!

Is this for only EAD people? What about folks left out prior to August 2007 and not eligible to file in EB3? I am interested in fight for EB3 people who left out and yet to be filed I-485. FYI EAD folks are fine.

I have Started my porting effort today. I work for one of the Top 10 FORTUNE 500 Compnies. Joined 18 months ago on AC21. Spoke to the HR today and the response seems to be positive.

Even the "Dream act" with the active support of the President did not come through. The corporates are interested in H1 / L1 to serve their own interests. No one will support us to speed up the GC process as they gain nothing!
Let us attack the root of the problem -
The root of the problem is because porting process is not simple. Every day we hear stories of impediments at every level. IV can certainly help in getting the admin blocks removed. Please also see my previous post on the issue.
We can pursue to get the following admin fixes :
1. Get a circular for job change for all EAD candidates after they have completed 6 months
2. Plead with law makers / INS to ensure that employees cannot revoke I 140 of an employee leaves the organization 6 months after he gets the EAD. No one can threaten someone to stay at work in the USA. I am sure the law makers and INS will be sympathetic to our cause and help us. Let us be positive.
3. We must request INs to treat all EB3 candidates who have -
- completed 6 years and more in the profession on par with EB2 (may be difficult)
- been promoted and have taken up managerial positions since the filing of labour / I
140 on par with EB2 (should be possible)
- who qualified themselves with higher education (Masters) since filing (this should be
easy)
First of all we must ensure that the fear element is addressed. This will give many deserving candidates the opportunity to port
Any other suggestions are welcome!

I have recently visited the Congressman's office and this the feedback I got:
"Under the current circumstances, immigration is the least of the worries for the government". I think there is no need for me explain further on this.
The immediate measure to give relief to several hundred EB3 people would be to make the porting process transparent and smooth. It is true that the bottle neck will remain, but atleast genuine and experienced people who are waiting since 2003 or so will get benefited. I think it is fair
To help well qualified EB3 folks who have put in several years of experience it would be a good idea to work on some admin fixes such as :
1. Eliminating the fear element related to I-140 withdrawal by the employers. In other words, if someone with EAD gets a job and if he files an AC21, he should be free to work at will. The employer should not be permitted to withdraw I-140. (In fact I really do not know if the employer can do it)
2. We should request the INS to issue the ground rules for job transfers for EAD holders. This will eliminate the unwanted stress and tension and harassment by employers.
3. Once people are "liberated" from this bonded labour, they can file for porting boldly.
Atleast we can start a mass mail campaign (letters please, no emails) to all the local congressmen and senators to ensure that INS lays the ground rules and makes it official that EAD holders in EB categories can switch jobs and port after 6 months of receiving the EAD.
It will be a good idea to write letters and then make follow up visits.
I learnt from the Murthy website that there is no written circular or format for AC21. This is the main problem. If the INS clears the road and lays the rules, qualified EB3 friends in the eternal line can come out of this mess.
I am willing to play my part. Kindly think about it and share your thoughts. Let us start, please! Doing nothing will not help anyone. Never lose hope !!!

Note:
I have no complaints against people who are happy with their EADs. However, if they have grown up kids, they should realize that without a GC even if they stayed in a state for 10 years, they will NOT be eligible for local fees in Public universities. The children will be enrolled as 'International Students" and non GC folks will have to pay about USD 45000 - 50000 per annum as tuition fees. Is it OK? Can we all afford it?
In fact even to participate in some high shool level competitions (and scholarships too)conducted by certain leading corporates, the children have to be GC holders. To get scholarships in UG courses, you still have to be a GC holder. Scholarships are first given to citizens and GC holders. This is just for your information.
