View Full Version : 60 days + on RFE, wait for visa #?

Hi,

It has been past 60 days since NSC received my response to their I140 RFE. I am sure many people are in the same boat, but I don't know what is the current mode of action at USCIS. Are they waiting to process the I140 until a visa # is available - that will take a few more years.

Do you think they have processed the RFE? If they had to deny the petition, they would have done it by now, right?

I140 has nothing to do with visa numbers?

I realize that I140 and visa numbers are not linked but I remember reading somewhere that they have slowed down approving I140 until a corresponding visa number is available for concurrent filers as I485 is basically sitting there, waiting for I140 to be approved. But, I could be wrong.

So, since it has been more than 60 days, I should be hearing from them soon. I was unable to talk to the customer service rep on Monday. Do you guys think an infopass appt will help in figuring out the status of my application or it is better to just let it be?

My 140 EB2 got approved on Dec 16th 2008. We replied to RFE on Aug 28th 2008 from NSC. It took nearly 4 months. I think it is nothing to do with visa numbers for 140 process. 140 process is very slow these days. My lawyer haven't done anything after we cross the 60 days period, no SR's or nothing.

Be patient and wait. You will get your approval soon. If you are worried, ask your attorney or employer to call USCIS and inquire about it.

One of my friends got an RFE for an I-140 filed in Aug 2007 in November 2007. It has been more than an year now and he has not heard back anything from USCIS. USCIS does things at random. They could make a decision on your I-140 tomorrow or it could be pending for another year. All you can do is wait. You can try talking to a customer service rep but I guess all they will tell you is the thing that shows online and ask you to wait .
