My 6 year H1B is expiring on September 30th, 2011
I have my I-140 approved and employer has filed for 3 year extension on June 30th (Regular Processing)
I am travelling to India on August 15th due to medical emergency and work from there for next 5-8 months for the same employer.
Most likely 100%, I won't get H1B approval before I leave in next 10 days
1) Is it ok if I leave with this situation.
2) Can I ask the lawyer to mail my H1B extension to India once it is approved? If he can mail it, I can for visa stamping in India after Oct 1st, 2011
3) If everything goes well including H1B stamp in India, I can easily come back to US after 6 months ?
Will there be any problems if I am travelling while H1B is pending?
