Perm Application in advertisement stage

Hi,

I am in my 6th year on H1B expiring Aug 31st 2009.
My company is applying to GC and are at advertizement phase and have told me that it takes 3-4 months.

Also, it will take another 3-4mos (assuming no audit).

My question:
- Can I get extension on H1B if Labour is approved?
- Do I need to have I140 & 485 approved to get extension. Also, do I have enough time for I140 & 485 approved.

I am applying on Pakistan (cross-charge) quota in EB2 catagory.

How much do you think company is responsible if approvals did not come through as they asked me take role in US knowing my visa situation?

The company is not responsible if the visa is not come thru. Just you have to pack up and go.

Hey there is something calling reclaiming unused time on h1b, all these 6 years where you inside US or did u travel out.

If you had travel outside the country u can keep track of all that I-94 details and claim unused time on your h1.

Also if you are not near the end of your h1, you can immediately take vacation and go to your home country and come back.

But check about this with your attorney before you make any decisions, i am just suggesting the idea.
