View Full Version : H1 and H4 visa status at the same time

Hello All,
I have a certain set of questions regarding the H1 and H4 status

I am currently on an L2 visa as a dependent on my spouse the L1 holder. I am not employed currently on L2, however i have found myself an employer who is ready to file for my H1B for the year 2012, in a couple of weeks.
Mean while my spouses employer is filing for his H1 and my H4 as well.
So the situation is my H1 and my H4 application will be under processing in the same period.

1.Is this a valid situation to apply for H1 and H4 by different employers in the same period for processing?
2. If my H1 B gets approved and then H4 is taken up for processing later will my approved H1 status become void and i will get the status of H4? and vice-versa.
3. In short can I hold the status of H1 as well as H4 but use only one of the two?

Need of an urgent reply.

Yes, different employer can file different petitions for you. However, you can only be in one status at a time. So the latest approval will determine your final status.

2. If my H1 B gets approved and then H4 is taken up for processing later will my approved H1 status become void and i will get the status of H4?

Yes, you will move to H4 status.


and vice-versa.
3. In short can I hold the status of H1 as well as H4 but use only one of the two?

You can be in only one status at any given time.

I had heard that for the H1B visa to turn void the employer has to initiate the request, if the employer is ready to keep me on H1B status, still will the filing of H4 (by some other employer) automatically remove my current approved H1B status.

VISA is different from status.
if the employer is ready to keep me on H1B status, still will the filing of H4 (by some other employer) automatically remove my current approved H1B status.
