According to the demand data published by USCIS today <<Link>> (http://www.travel.state.gov/pdf/EmploymentDemandUsedForCutOffDates.pdf), EB2 demand data prior to Jan-1-2007 is only 15 (5 China, 10 India). But I know there are a lot of folks like me who have been current for at least a month or more and haven't received approvals yet.
We want to understand how USCIS comes up with these numbers, so lets gather here to collect at least the IV EB2 folks whose priority date is earlier than Jan-1-2007, i.e were current in July 2011 bulletin or earlier and are still waiting for approvals. This way, maybe IV can go back to USCIS with these numbers requesting explanation.
Please post Priority Date, Country of Changeability, 485 Rcpt Date, Current Since.

Case transferred from TSC to NSC in Aug 2009,
got a RFE in Nov 2009 requesting proof of employment listed in original app for which they suggested I can send docs like Experience Letters, tax returns, W4s, Pay Stubs etc., and I sent in pretty much everything from 2002 to 2009 in Dec 2009... it's been pending since with no updates.
Created an SR in July for which I got a response back saying it's under extended review and I should hear back within 6 months.
Please mention the porting date if you ported EB3 to EB2.

What actions have you taken till now after getting current: Number of service requests, Congressmen inquiries, info passes etc.. Briefly state the reason for delay.
And if we find someone in this list of 10 people pending for more than 6 months despite being current all the time, IV can even consider helping this applicant. Waiting beyond 6 months after getting current and beyond processing time is wrong in my opinion and USCIS should fix this. If someone has filed I485 many years ago and has been current since last 6 months, the anxiety level of that person must be really high and if despite raising a service request, the case is not approved. It means USCIS must investigate the reasons of the approval delays.

The frustrating part was that they told me during local office interview that everything looks good and it will be approved after the numbers are current. Then, it was transferred to TSC to speed up the process. Recently, they moved it back to NSC again to "speed up" the process.

TSC. Mine was not a complicated case. Had interviews at the local office a couple of years ago. I did submit an SR in June. Got a response a couple of weeks ago that my file had been requested and that they would process the application after they got the file. I was convinced that the "file" had probably gone missing.

I think It is important to count family members also.
Looks like USCIS Demand data only count primary applicant (not pending family members).

Demand data will include dependent. At least each dependent has their own 485 application. Could it be other applications already have visa number requested and assigned, pending process by IO. There is a delay @ the processor / IO level - Just assumption

I think family members are counted too, but that's just my thought.
In which case, we are already more than 10 people waiting here and assuming an average of two people per each of the responses we received so far, we are already more than 20...
but then again, I am not sure how USCIS came up with that number.. did they already request visa numbers for most of these pending cases and hence not counted against the pending demand?

I know it's been a while since this thread was active, but unfortunately I and a few? other unlucky souls are still waiting, and I am bumping this thread up to gather all those folks who have been current for more than 2 months and still waiting in hopes of IV following up with USCIS to understand the reasons behind our wait...
Can you please reply to this thread with your details if you have been current since at least July 2011 bulletin or earlier and are still waiting?

The first RFE was regarding a new G325A form. My lawyer promptly sent the information
The 2nd RFE was for some additional details in my wife's birth certificate. The required information was sent to them.
Opened an SR in July 2011 and I got the standard response that they are reviewing the case.

My attorney received the RFE. It was for Employee Verification and to also prove that I was in legal status since July 2007. All stupid crap since all of this was sent with the new I-140 petition. My attorney [in GA] got the RFE in the mail within 5 business days.

One thing I am noticing here is that more than 50% of the waiting cases are the ones which are transferred from TSC to NSC.... is it just coincidence, or does NSC have some issue with processing transfer cases?

I would advise you to send an email to nsc.followup [you can google for the exact email address] and ask them to re-send the RFE or provide you the text of what it needs.

The oct visa bulletin did hint at the possibility of retrogression further down the road. With that in mind, is there anything we can do to get a resolution to the pending cases?
With thanksgiving round the corner, maybe we can start sending in some glazed hams... I still have a couple of coupons left over from the flower campaign ...Ideas welcome!

I also sent the e-mail to NSC followup. During my first e-mail, I was told that the case it at NSC, but not with an officer and expect a decision in 30 days. I waited 30 days, but no news. I replied to the same e-mail and told them I waited 30 days. Within 3-4 days, I got the approval.
For people who got struck, I recommend contacting through NSC follow up e-mail. At least, it was fruitful in my case even though it took a while for them to reply.

Please check visa bulletin for your visa updates." which is ridiculous! my priority date (Sep 26 2006) has been current since the June bulletin.

Until now there was some hope to receive the magical email. But now we probably have to wait until next year, unless the experts think I'm wrong.
What frustrates me is folks with PD in 07 got approved and received GC before us. What's the use of PD then?

I put in the subject line "485 pending and priority date current". In the body of the e-mail, I gave all the details, such as receipt number, receipt date, DOB, A#, PD etc. I also attached my receipt number. I mentioned that my PD was current and I would like to know when it will be adjudicated. I also mentioned that I completed my biometrics as well.

I am not sure how long we need to wait or what to do next. Our PD was current in May 2011 and we still did not receive our card.
I raised SR on May 25 while talking to customer service and got standard response for SR 'performing additional review and contact us after 6 months'. I also took Infopass on June 27 and I was told ..'Your case is pre-adjudicated and it is under active processing'. I really do not know what to do next.
Appreciate suggestion from Pappu and others.
Porting - NO
Interfiling - No
Case in local office No
RFEs after filing I485 - No
Dependent added after filing I485- No
Multiple I485s for the same applicant- no
Multiple I140 for the same applicant - no
Any other complexity with the case: None

My PD is in Apr 2007, and I am current this month. waiting to see if something happens but looking at the posts in this thread looks like people from 2006 are still waiting so not so hopeful.
Does anyone see any Soft LUD once our date is current?

I am still waiting. No updates from USCIS yet. PD is AUG06-EB2, with the WAC service number. Last time when I checked my file it is at MSC...

EB3 I-140 and I-485 are in NSC and EB2 I-140 is in TSC.
Some of the older posts seem to indicate delays related to linking the files if they are in multiple servicing centers. I am not sure how long would it take to link them.
Also, applications with older priority dates seem to be getting FP notices again. My last FP was in 2005. All these would add significant delays. I would consider myself lucky if it gets approved before Nov/Dec.

My date has been current since June 2011 and no updates yet. I'm thinking of taking an Infopass at Atlanta (that's where my file is). I'll have to fly from DC to Atlanta.
Can somebody let me know if that's a good idea?
I'm not sure how the visa numbers work and if there are any more visa numbers left for people stranded like me.

If you are a donor member contact IV.They will help you get greencard. They help donor members who have been current get greencard. Or you can choose to wait few more months, call USCIS, Lawyer and congress every other day for next few months.

That just doesn't sound right, but I can understand your rationale behind that argument, and I am not complaining... I have donated to IV on cause basis, and will continue to do so... but if you are right, and IV indeed helps it's donor members with a situation like mine, I might consider becoming a paying member.
Can anyone from IV (pappu?) confirm that IV can immediately help folks like me if they were donor members?

I was really hoping their wait 6 months was like the absolute worst case scenario, and looking at others wait for longer than that crashed all my hopes... gotta do something, this is ridiculous... they don't even tell give a meaningful reason for the delay :mad:

Got a response from USCIS when my lawyers raised a SR.
"The status of this service request is:
Thank you for your recent inquiry. We are aware of the current priority date for this case.
A check of our records establishes that your case is not yet ready for decision, as the required investigation into your background remains open.
Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. If you do not receive a decision or other notice of action from us within 6 months of this letter, please contact customer service at the number provided below."
So I guess there is nothing to do but wait.

I was finally able to get someone at my local senator's office review my request to help (took 6+ weeks of followups), and surprisingly she made a call to USCIS Nebraska service center while she put my call on hold, and she told me that they said that my case is in the final stages of processing and I should hear a decision with 90 business days.
I don't know if I should be mad or happy... this thing seems to never end.. :(

Good Luck. Did you personally visit the office or communicating over the phone with the local senator's office?
I am in congressman Ron Paul's district. So none of my queries are getting any traction as his staff is busy with his campaign...

I was following up via calls.. I tried going in to my congressman's office and their response was no diff to that of the phone calls, so decided to stick with calling.

I am in total support for HR 3012 and have made calls to many congressman/senators and done some more follow ups to help this bill.
That being said, I do not believe the issue we (in this thread) are facing is somethign that will directly be affected by HR 3012 as we have been current for over 6 months already, and if I understand correctly, HR3012 will make a lot of folks' PD current or close to it, which infact may increase the processing times by USCIS.
Also, as requested earlier in this thread, is there anything IV can do in our cases?

hi Guys,
My 6 months from the SR response time has completed this week and unfortunately I am still waiting, but there have been some encouraging changes on my end and wanted to keep others waiting informed, as well as ask my questions here.
I called L2 support this week (Monday) and was told that it's still pending and without asking me he raised another SR and told me that I should hear back by Feb-7th about the status of my case. My lawyer has suggested I take an infopass and also file a case with Ombudsman, so I went in for an infopass yesterday and I was a little surprised to hear a little different response this time.. instead of the usual it's pending blah blah...
The IO @ infopass told me that there was a recent movement in my case, and that my case was assigned to the final adjudicating officer on Jan-23rd-2012. She said that this is the final step and she thinks that whatever they were holding my case for so long has now been cleared. She also said that she is seeing in the system that the officer has requested a visa number from state department on the 23rd but she can't tell if it was granted or not since that's a state dept thing which she doesn't have access to. She said I should see the response in at most 30 to 45 days.
It seemed very encouraging, but I am really not sure if I can trust anyone at USCIS. After all, I was told my case was pre-adjudicated long time ago and obviously I am still waiting. Did anyone here ever had such responses from USCIS and do you guys think my case is really moving along? If her note regarding visa number being requested is true, does it mean everything else is done and they are probably just waiting for the visa number to approve my case, or am I being a little too optimistic here?
Any feedback is greatly appreciated and I wish everyone else waiting the very best and hope we'll all end this miserable wait on a happy note.. soon.

coolpal - thats great news..at least it is encouraging. I hope that you get greened before Feb7. My case is worse than yours I think!. I had setup an infopass appointment last December, but the IO did not give any useful info except that I need to approach NSC for any information! I got a RFE last month which was the same RFE they raised a year ago. It is more than a month since we answered it and still I haven't got any response. It has been an agonizing wait so far and I don't understand what is happening especially after I was told that it was preadjudicated long time back. Keep us posted about any other developments.

I got my green card finally today after 5 yrs and 2 months since filing the labor. Was current from July 2011 onwards but for some reason the file was not picked up for a long time. Hope everyone else who have priority date in 2006 and still waiting will get them soon.

...huge thanks to IV. Without this wonderful community and their (our) extra ordinary effects my miserable wait would have been impossible to bear.
I'm sure to stick around to help others with the knowledge I acquired during my long ride with USCIS (this happens to be my 10th year in the US), if nothing else, I can offer some moral support to folks who are desperate ;)

After a long wait I got the interview letter from USCIS for Apr 18th. I have been expecting this as my wife was called for an interview on Jan 25th and the office told me I would be called for an interview as well. I'm still not sure why they would call me for an interview, but I'm more happy than nervous :-) I'm one of the few ppl with PD in 2006 and application stuck without any action.
