Hello guys,

I am entangled in a tricky situation. My H1 for Oct 2011 start date was approved on the 15th of July, 2011. The USCIS had mailed all the relevant documents i.e. approval notice, etc. to the attorney, who in turn mailed the relevant documents to me, at the address that I had used for filing the H1. Since I was forced to move my residence at that time, the mail was returned to USCIS as undeliverable.

This is my current online case status.

"On July 26, 2011, the post office returned the notice we last sent you on this case I129 PETITION FOR A NONIMMIGRANT WORKER as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent."

When I called the USCIS to change my address, I was told only my employer or the attorney who filed the application can update the address. But my employer is reluctant to do this and hence wants me to do an online AR-11.

But even the AR-11 form gives me only two options a) If I am the petitioner b) If I am the attorney who filed the petition.

My employer has given me the attorney details. Is it safe for me to just do the AR-11? Is the USCIS document the only proof for me in the future when I leave the country and have to get the passport stamped.(I am currently on cap gap). Kindly help.

I am guessing that the employer address has not changed. and since the attorney just forwarded the same envelope, from USCIS, to your old address, it got sent back to the USCIS address.
Call the number and explain that the employer/attorneys' address has not changed and send those docs to the same address again. Ask you attorney to FedEX it to you in another envelope.

And yes, this is a serious. You should have your original H1b approval notice.

Thanks for the reply sac-r-ten. Sounds like a good idea. But I am not sure if the USCIS will agree if I, being just the beneficiary and not the employer or attorney, call them and tell this. The last time I called them I was told that I have no right to change the address or bring up any issues for that matter, and only the employer who sponsored the application or the attorney who filed it can call them
