View Full Version : After GC: how long do I need to hold myslef back from searching new job

I have received my Green Card this week. I had switched my employer using AC21 in 2009. So my current employer is not really the original I 140 sponsor for me. Do I need to stay with my current employer now after getting my GC or can I change employer. If I need to stick with my current employer, is there a time limit in terms of months?

You should not do something which clearly shows that you had no intention of continuing employment with your GC sponsor , you just used them for a "vehicle to GC".

Some actions which can prove that your intention was wrong :

a) You worked with them for sometime but u suddenly left them the immediate next month.
b) You never worked for the GC sponsor and even after getting GC u didn't work for
them for anytime.
c) You worked with them for sometime after GC but when you are leaving your employer complains that you used them just as a "sponsor"

The Point c) is a matter of argument because employer can say that even if you worked for them sometime. So to tilt the scale towards you - work for some reasonable time, give them some ROI and then leave some genuine reasons - Like your wife works far away so you are joining her and changing job , you got a highly exciting and challenging Job offer which can change you career , wanted to try your Technical skills in a different business domain - you know reasons which no one can easily shrug off.

I could go on and get more creative but hope you know what I mean. Give it 6 months -1 year and have some solid reason documented and proven.

In the post AC21 world, I don't know how this rule is applicable? Just my thought. I know that murthy mentioned that it's still valid.

I had a paid telephonic conversation with a lawyer. As per him after AC21 that old rule does not hold good anymore. Moreover I had changed my employer on AC21 in 2009 so my current employer is not really my sponsoring original employer ( I mean they did not spent a $ on my processings). He said that I had already worked for the employer 2.5 years so he does not see any potential issue if I change. He said that now I am a free bird and should be bale to do whatever I want.

I am also consulting Murthy today and I will keep you updated.

You are anyway a bird now after GC - I was just saying that your wings will be fully grown after 6 months , take it EZ !!
