I had to give up my green card at the border voluntarily because I could not under pressure prove that I had been out of the country less than a year and my only options were either to voluntarily surrender the green card and accept a tourist visa to continue my entry into the U.S. that way or to wait at the airport the rest of the day and all night to the next day and appear in front of a judge to appeal . I had an extremely important appointment to make and a very young infant in my arms and chose to accept the tourist visa and give my green card up.
What are my possibilities of recovering the green card other than have my brother apply for me again and wait.

PLease talk to an attorney ASAP. You may not get an accurate answer to ur question here because here members may not have encountered such a situation. You may have some legal routes to atleast file a lawsuit or do something

They are known to pressure at POE and one should never give in to pressure come what may...You should now contact a lawyer to try to clean the mess if possible

One of my colleage's daughter landed in similar situation. She is studying in India for last three years. She has been visiting US every year. The did stop him previous years for staying longer outside India. This year she came back and they stopped her at port of entry. They took her green card and ask her to either voluntarily give up her green card or go to the court. They said she has been in US only for short period for last few years. They gave her temporary green card till the court date.
My colleage has contacted lawyer who had decided to contest. Also the lawyer working with government attornet to drop the case in backgroubd. Government attrney has agrred to drop the case provided giving a proof of applying for Advance parole.
You may need to contact a good lawyer to take your case.

Just a headsup to existing GC holders. Its wise to always apply for AP in advance for these kind of issues. My friend's parents have been visiting US once a year for a very long time without issues because they always applied for re-entry permit ahead of time.
