As long a you are getting paid from the company without any problem, you will be fine with ATP RFE. You need to submit your pay stubs/W-2s and letter from your CFO that the company can pay you the pro-offered wage. Many people got this RFE and successfully got approval after proper documentation.

Yes, there is clause about 180 days accommodation once the 485 is filed

Thanks for the reply.

Mine was a concurrent I-140 and 485 filing. Is the provision for 485 with I-140 approved, or is a provision for I-140 evaluation with 485 filed?

Any pointers to the specific page/para/clause in the "binder"?

Thanks again.

One of the questions on I-140 RFE goes like this:
"Submit evidence that the alien obtained the required two(2) years of programmer analyst experience in the job offered before the priority date was established on June 26, 2006. Evidence ...."

In reality the labor was filled for this EB3 I-140 in August 2003. This is not a substitution. I dont understand what they mean by "establised on June 26, 2006"? Can someone interpret this?

I believe you posted on the wrong thread. You might want to repost in the right thread so as to get the appropriate responses. :)

Seniors, any pointers on the specific clause in the legislation around the 180 day accomodation with some kind of penalty?

Thanks.
