View Full Version : Husband might lose job can I continue using my EAD

I was on F-1 and currently I am working on EAD. I got my EAD through my husband's application. My husband's I-140 is still pending but there are chances that he will lose his job. If he loses his job can I still continue working on the EAD?
If I can not work on EAD what option do I have?

As long as his I485 is either pending or adjudicated, you can continue to work on EAD.

Do you thing his I-140 petition would be withdrawn? If so, it would automatically trigger NOID for I-485.

Thanks for your response!! I am not sure about I-140 but if it is not withdrawn will I be able to renew EAD?

You can renew your EAD as long as the 485 is in pending status, it does not matter whether your 140 is pending or approved, but if 140 is withdrawn then 485 automatically denied hence you do not qualify for EAD renewal.

I believe the exceptiion might be in a case where in if its more than 180 days since u filed 485 then even if 140 is withdrawn you may be ok...
